Remove line(s) 1723-1746, and insert: |

(7)(a)The provisions of this section shall also apply as |
17
|
to any insurer or adjusting firm or its agents or |
18
|
representatives who, with intent, injure, defraud, or deceive |
19
|
any claimant with regard to any claim. The claimant shall have |
20
|
the right to recover the damages provided in this section. |
21
|
(b) An insurer, or any person acting at the direction of |
22
|
or on behalf of an insurer, may not change an opinion in a |
23
|
mental or physical report prepared under s. 627.736(7) or direct |
24
|
the physician preparing the report to change such opinion; |
25
|
however, this provision does not preclude the insurer from |
26
|
calling to the attention of the physician errors of fact in the |
27
|
report based upon information in the claim file. |
