13 Senate Amendment (with title amendment)
14 On page 77, between lines 10 and 11,
15
16 insert:
17 Section 20. (1) Notwithstanding the amendment to
18 section 627.7295, Florida Statutes, by CS/SB 2364, paragraph
19 (a) of subsection (5) of section 627.7295, Florida Statutes is
20 not amended as provided by that act, but is reenacted to read:
21 627.7295 Motor vehicle insurance contracts.--
22 (5)(a) A licensed general lines agent may charge a
23 per-policy fee not to exceed $10 to cover the administrative
24 costs of the agent associated with selling the motor vehicle
25 insurance policy if the policy covers only personal injury
26 protection coverage as provided by s. 627.736 and property
27 damage liability coverage as provided by s. 627.7275 and if no
28 other insurance is sold or issued in conjunction with or
29 collateral to the policy. The per-policy fee must be a
30 component of the insurer's rate filing and may not be charged
31 by an agent unless the fee is included in the filing. The fee

1 is not considered part of the premium except for purposes of
2 the department's review of expense factors in a filing made
3 pursuant to s. 627.062.
4 (2) This section shall take effect upon this act
5 becoming a law, except that, if this act does not become a law
6 before CS/SB 2364 becomes a law, this section shall operate
7 retroactively to the date that CS/SB 2364 becomes a law.

16 insert:
17 reenacting and amending s. 627.7295(5)(a),
18 notwithstanding amendments to that paragraph by
19 CS/SB 2364; providing for retroactive
20 application;
