11 Senator Alexander moved the following amendment:

14 On page 76, line 4, through
15 page 77, line 17, delete those lines
16
17 and insert: Subsections (1) and (2) of section 627.739,
18 Florida Statutes, as amended by this act, shall apply to new
19 and renewal policies issued on or after October 1, 2003.
20 (2) Subsection (11) of section 627.736, Florida
21 Statutes, as amended by this act, shall apply to actions filed
22 on and after August 1, 2003.
23 (3) Paragraph (7)(a) of section 627.736, Florida
24 Statutes, as amended by this act, and paragraph (7)(c) of
25 section 817.234, Florida Statutes, as amended by this act,
26 shall apply to examinations conducted on and after October 1,
27 2003.
28 (4) Subsection (5) of section 627.736, Florida
29 Statutes, as amended by this act, shall apply to treatment and
30 services occurring on or after October 1, 2003.
31 Section 17. By December 31, 2004, the Department of

1 Financial Services, the Department of Health, and the Agency
2 for Health Care Administration each shall submit a report on
3 the implementation of this act and recommendations, if any, to
4 further improve the automobile insurance market, reduce
5 automobile insurance costs, and reduce automobile insurance
6 fraud and abuse to the President of the Senate and the Speaker
7 of the House of Representatives. The report by the Department
8 of Financial Services shall include a study of the medical and
9 legal costs associated with personal injury protection
10 insurance claims.
11 Section 18. Effective July 1, 2003, there is
12 appropriated $2.5 million from the Health Care Trust Fund, and
13 51 full-time equivalent positions are authorized, for the
14 Agency for Health Care Administration to implement the
15 provisions of this act.
16 Section 19. (1) Effective October 1, 2007, sections
17 627.730, 627.731, 627.732, 627.733, 627.734, 627.736, 627.737,
18 627.739, 627.7401, 627.7403, and 627.7405, Florida Statutes,
19 constituting the Florida Motor Vehicle No-Fault Law, are
20 repealed, unless reenacted by the Legislature during the 2006
21 Regular Session and such reenactment becomes law to take
22 effect for policies issued or renewed on or after October 1,
23 2006.
24 (2) Insurers are authorized to provide, in all
25 policies issued or renewed after October 1, 2006, that such
26 policies may terminate on or after October 1, 2007, as
27 provided in subsection (1).
28 Section 20. If any law that is amended by this act was
29 also amended by a law enacted at the 2003 Regular Session of
30 the Legislature, such laws shall be construed as if they had
31 been enacted during the same session of the Legislature, and

1 full effect should be given to each if that is possible.
2 Section 21. Except as otherwise expressly provided in
3 this act, this act shall take effect October 1, 2003.
