Section 53. (1) Notwithstanding the provisions of s. |
|
18
|
1006.37, Florida Statutes, the Department of Education may |
|
19
|
conduct a pilot program to enable selected school districts to |
|
20
|
realize cost savings without loss of quality or availability for |
|
21
|
individual students in the purchase of used instructional |
|
22
|
materials.
|
|

|
(2) The school districts of Hernando County, Pasco County, |
|
24
|
and Polk County may participate in the pilot program. Charter |
|
25
|
schools in such school districts shall be eligible to |
|
26
|
participate in the pilot program. When a secondhand book dealer |
|
27
|
or other third-party book vendor provides used adopted |
|
28
|
instructional materials to a school district, the dealer or |
|
29
|
vendor must certify the availability of the used instructional |
|
30
|
materials, provide the International Standard Book Number of |
|
31
|
each of the used instructional materials, and certify that such |
|
32
|
materials are not samples or first printing, are the most |
|
33
|
currently adopted, Florida-specific instructional materials, and |
|
34
|
that the materials conform to the Sunshine State Standards.
|
|

|
(3) The state is not responsible for financial loss caused |
|
36
|
by the school district’s deviating from the requirements of s. |
|
37
|
1006.37, Florida Statutes. The Council for Education Policy |
|
38
|
Research and Improvement shall submit to the President of the |
|
39
|
Senate and the Speaker of the House of Representatives for |
|
40
|
consideration during the 2004 Regular Session a report of the |
|
41
|
cost savings to school districts based on results of the pilot |
|
42
|
program.
|
|

|
(4) This section is repealed July 1, 2006.
