17 Section 33. Section 627.096, Florida Statutes, is
18 amended to read:
19 627.096 Workers' Compensation Rating Bureau.--
20 (1) There is created within the department a Workers'
21 Compensation Rating Bureau, which shall make an investigation
22 and study of all insurers authorized to issue workers'
23 compensation and employer's liability coverage in this state.
24 Such bureau shall study the data, statistics, schedules, or
25 other information as it may deem necessary to assist and
26 advise the department in its review of filings made by or on
27 behalf of workers' compensation and employer's liability
28 insurers. The bureau shall analyze proposed legislation and
29 shall give advice and make recommendations to the Legislature
30 as to the potential impact on rates of such pending
31 legislation. The department shall have the authority to

1 promulgate rules requiring all workers' compensation and
2 employer's liability insurers and rating organizations to
3 submit to the rating bureau any data, statistics, schedules,
4 templates, models, calculations, and other information related
5 to rates and ratemaking deemed necessary to the rating
6 bureau's study and advisement. All such information submitted
7 to or considered by the rating bureau is public record;
8 however, this does not require the disclosure of individual
9 claim information that is otherwise confidential under law.
10 (2) The bureau may contract with an independent
11 actuary who is a member of the American Society of Actuaries
12 to assist it with its responsibilities under this section;
13 however, to prevent conflicts of interest, the bureau may not
14 contract with an insurer, a rating organization, or an actuary
15 or other entity affiliated with an insurer or rating
16 organization to provide services in conjunction with the
17 bureau's responsibilities under this section. Costs incurred
18 under this subsection associated with the analysis of proposed
19 legislation shall be paid from the Workers' Compensation
20 Administration Trust Fund.
21 (3)(2) The acquisition by the Department of Management
22 Services of data processing software, hardware, and services
23 necessary to carry out the provisions of this act for the
24 Treasurer's Management Information Center of the Department of
25 Insurance shall be exempt from the provisions of part I of
26 chapter 287.
