Between lines 279 and 280, insert: |

Section 7. (1) Notwithstanding the provisions of this |
17
|
act, House Bill 1839, adopted during the 2003 Regular Session of |
18
|
the Legislature, and Senate Bill 18E, adopted during the 2002 |
19
|
Special Session E of the Legislature, and any provision of s. |
20
|
220.03, Florida Statutes, providing for giving effect under the |
21
|
Florida Income Tax Code to amendments to the Internal Revenue |
22
|
Code, any provision of the Internal Revenue Code of 1986, as |
23
|
amended, which took effect after January 1, 2002, pursuant to |
24
|
the Job Creation and Worker Assistance Act of 2002, shall not be |
25
|
included within the meaning of the term "Internal Revenue Code," |
26
|
as defined in s. 220.03, Florida Statutes, for purposes of the |
27
|
tax imposed by chapter 220, Florida Statutes, on the income of a |
28
|
corporation and shall not be given effect under the Florida |
29
|
Income Tax Code.

|
(2) The Department of Revenue shall adopt rules to |
31
|
implement the provisions of this section.
|

|
Section 8. The sum of $124 million, available as a result |
33
|
of nonapplication of the provisions of the Job Creation and |
34
|
Worker Assistance Act of 2002 under the Florida Income Tax Code |
35
|
pursuant to section 7, or the full amount made available if less |
36
|
than $124 million, is appropriated from the General Revenue Fund |
37
|
as follows: one-half to the Florida Education Finance Program |
38
|
and one half to the State University System.
