1 A bill to be entitled
2          An act relating to optional medical assistance and related
3    services payments; amending s. 409.904, F.S.; authorizing
4    use of funds for Medicaid for certain persons; providing
5    eligibility criteria; providing income and asset
6    limitations; providing for construction of the act in pari
7    materia with laws enacted during the 2003 Regular Session
8    of the Legislature; providing an effective date.

10          Be It Enacted by the Legislature of the State of Florida:
11         
12          Section 1. Subsection (11) is added to section 409.904,
13    Florida Statutes, to read:
14          409.904 Optional payments for eligible persons.--The
15    agency may make payments for medical assistance and related
16    services on behalf of the following persons who are determined
17    to be eligible subject to the income, assets, and categorical
18    eligibility tests set forth in federal and state law. Payment on
19    behalf of these Medicaid eligible persons is subject to the
20    availability of moneys and any limitations established by the
21    General Appropriations Act or chapter 216.
22          (11) Funds may be used to provide Medicaid to persons at
23    least 16 but less than 65 years of age who would be considered
24    eligible for supplemental security income but for earnings in
25    excess of the limit established under s. 1905(q)(2)(B) of Pub.
26    L. No. 106-170, who is enrolled in Medicaid before July 1, 2003,
27    and whose income does not exceed the income limit specified in
28    subsection (1) or a lower income limit as specified by
29    administrative rule. Earned income of up to 250 percent of the
30    federal poverty level, after application of the supplemental
31    security income earned income disregards, shall be disregarded
32    in determining eligibility. The asset limit shall be $8,000 for
33    an individual and $9,000 for a couple, excluding a second
34    vehicle, if there is a spouse living in the home, and all funds
35    placed in a retirement account recognized by the Internal
36    Revenue Service. Effective July 1, 2006, this subsection shall
37    apply to any person who is eligible to enroll in Medicaid.
38          Section 2. If any law amended by this act was also amended
39    by a law enacted at the 2003 Regular Session of the Legislature,
40    such laws shall be construed as if they had been enacted at the
41    same session of the Legislature, and full effect shall be given
42    to each if possible.
43          Section 3. This act shall take effect July 1, 2003.
