1 A bill to be entitled
2          An act relating to license plates; providing legislative
3    intent to require display of front and rear license
4    plates; amending ss. 316.605 and 320.06, F.S.; revising
5    provisions for display of such plates; amending s.
6    320.0802, F.S.; providing surcharge on license tax;
7    providing for distribution of funds; amending s.
8    320.08056, F.S.; revising the educational license plate
9    use fee; providing a use fee; amending s. 320.08058, F.S.;
10    creating the H. Lee Moffitt Cancer Center and Research
11    Institute license plate; providing for distribution of
12    funds to that institute; providing for construction of the
13    act in pari materia with laws enacted during the Regular
14    Session of the Legislature; providing an effective date.
15         
16          Be It Enacted by the Legislature of the State of Florida:
17         
18          Section 1. It is the intent of the Legislature that all
19    automobiles, trucks, motor vehicles for hire, and recreational
20    motor vehicles have an identifiable license plate on both the
21    front and rear of the vehicle to improve public safety.
22          Section 2. Subsection (1) of section 316.605, Florida
23    Statutes, is amended to read:
24          316.605 Licensing of vehicles.--
25          (1) Every vehicle, at all times while driven, stopped, or
26    parked upon any highways, roads, or streets of this state, shall
27    be licensed in the name of the owner thereof in accordance with
28    the laws of this state unless such vehicle is not required by
29    the laws of this state to be licensed in this state and shall,
30    except as otherwise provided in s. 320.0706 for front-end
31    registration license plates on truck tractors, display the
32    license plate orboth of the license plates assigned to it by
33    the state, one on the rear and, if two,the other on the front
34    of the vehicle, each to be securely fastened to the vehicle
35    outside the main body of the vehicle in such manner as to
36    prevent the plates from swinging, with all letters, numerals,
37    printing, writing, and other identification marks upon the
38    plates clear and distinct and free from defacement, mutilation,
39    grease, and other obscuring matter, so that they will be plainly
40    visible and legible at all times 100 feet from the rear or
41    front. Nothing shall be placed upon the face of a Florida plate
42    except as permitted by law or by rule or regulation of a
43    governmental agency. No license plates other than those
44    furnished by the state shall be used. However, if the vehicle is
45    not required to be licensed in this state, the license plates on
46    such vehicle issued by another state, by a territory,
47    possession, or district of the United States, or by a foreign
48    country, substantially complying with the provisions hereof,
49    shall be considered as complying with this chapter. A violation
50    of this subsection is a noncriminal traffic infraction,
51    punishable as a nonmoving violation as provided in chapter 318.
52          Section 3. Paragraph (a) of subsection (1) of section
53    320.06, Florida Statutes, is amended to read:
54          320.06 Registration certificates, license plates, and
55    validation stickers generally.--
56          (1)(a) Upon the receipt of an initial application for
57    registration and payment of the appropriate license tax and
58    other fees required by law, the department shall assign to the
59    motor vehicle a registration license number consisting of
60    letters and numerals or numerals and issue to the owner or
61    lessee a certificate of registration and twooneregistration
62    license plate, unless two plates are required for display by s.
63    320.0706,for each vehicle so registered.
64          Section 4. Section 320.0802, Florida Statutes, is amended
65    to read:
66          320.0802 Surcharge on license tax.--
67          (1) In addition to any other surcharge imposed under
68    subsections (2)-(5),there is hereby levied and imposed on each
69    license tax imposed under s. 320.08, except those set forth in
70    s. 320.08(11), a surcharge in the amount of $1, which shall be
71    collected in the same manner as the license tax and deposited
72    into the State Agency Law Enforcement Radio System Trust Fund of
73    the Department of Management Services.
74          (2) From July 1, 2003, to June 30, 2004, there is levied
75    on each license tax imposed under s. 320.08(2), (3), (4)(a)-(f),
76    (6), and (9), except those set forth in s. 320.08(2)(a), (3)(d),
77    and (3)(e), a surcharge in the amount of $20, which shall be
78    collected in the same manner as the license tax.
79          (3) From July 1, 2004, to June 30, 2005, there is levied
80    on each license tax imposed under s. 320.08(2), (3), (4)(a)-(f),
81    (6), and (9), except those set forth in s. 320.08(2)(a), (3)(d),
82    and (3)(e), a surcharge in the amount of $10, which shall be
83    collected in the same manner as the license tax.
84          (4) Beginning July 1, 2005, there is levied on each
85    license tax imposed under s. 320.08(2), (3), (4)(a)-(f), (6),
86    and (9), except those set forth in s. 320.08(2)(a), (3)(d), and
87    (3)(e), a surcharge in the amount of $5, which shall be
88    collected in the same manner as the license tax.
89          (5) For license taxes imposed under s. 320.08(2)(a),
90    (3)(d), and (3)(e), a surcharge in the amount of:
91          (a) Five dollars shall be levied from July 1, 2003, to
92    June 30, 2004.
93          (b) Two dollars and fifty cents shall be levied beginning
94    July 1, 2004.
95          (6) Of the proceeds of the license tax surcharge under
96    subsections (2)-(5), less $1.50 for each license, 50 percent
97    shall be deposited into the General Revenue Fund and 50 percent
98    shall be deposited into the Principal State School Trust Fund.
99          Section 5. Paragraph (h) of subsection (4) of section
100    320.08056, Florida Statutes, is amended, and paragraph (mm) is
101    added to said subsection, to read:
102          320.08056 Specialty license plates.--
103          (4) The following license plate annual use fees shall be
104    collected for the appropriate specialty license plates:
105          (h) Florida educational license plate, $20$15.
106          (mm) H. Lee Moffitt Cancer Center and Research Institute
107    license plate, $25.
108          Section 6. Subsection (39) is added to section 320.08058,
109    Florida Statutes, to read:
110          320.08058 Specialty license plates.--
111          (39) H. LEE MOFFITT CANCER CENTER AND RESEARCH INSTITUTE
112    LICENSE PLATES.--
113          (a) The department shall develop an H. Lee Moffitt Cancer
114    Center and Research Institute license plate as provided in this
115    section. The word "Florida" must appear at the top of the plate,
116    and the words "Moffitt Cancer Center" must appear at the bottom
117    of the plate.
118          (b) The annual use fees shall be distributed to the H. Lee
119    Moffitt Cancer Center and Research Institute.
120          Section 7. If any law amended by this act was also amended
121    by a law enacted at the 2003 Regular Session of the Legislature,
122    such laws shall be construed as if they had been enacted at the
123    same session of the Legislature, and full effect shall be given
124    to each if possible.
125          Section 8. This act shall take effect upon becoming a law.
