An act relating to specialty license plates; amending ss. |

320.08056 and 320.08058, F.S.; creating a Live the Dream |

license plate and a UNITY license plate; providing for the |
5
|
distribution of annual use fees received from the sale of |
6
|
such plates; providing for construction of the act; |
7
|
providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
10
|
|
11
|
Section 1. Paragraphs (mm) and (nn) are added to |
12
|
subsection (4) of section 320.08056, Florida Statutes, to read: |
13
|
320.08056 Specialty license plates.-- |
14
|
(4) The following license plate annual use fees shall be |
15
|
collected for the appropriate specialty license plates: |
16
|
(mm) Live the Dream license plate, $25. |
17
|
(nn) UNITY license plate, $25. |

|
Section 2. Subsections (39) and (40) are added to section |
19
|
320.08058, Florida Statutes, to read: |
20
|
320.08058 Specialty license plates.-- |
21
|
(39) LIVE THE DREAM LICENSE PLATES.-- |
22
|
(a) The department shall develop a Live the Dream license |
23
|
plate as provided in this section. The word "Florida" must |
24
|
appear at the top of the plate, and the words "Live the Dream" |
25
|
must appear at the bottom of the plate. |
26
|
(b) The annual use fees shall be distributed to the Dream |
27
|
Foundation, Inc., which may use up to 25 percent of the proceeds |
28
|
to market the organization's concept and the license plate. The |
29
|
remaining funds shall be used in the following manner: |
30
|
1. The Dream Foundation, Inc., shall retain all revenues |
31
|
from the sale of such plates until all startup costs for |
32
|
developing and establishing the plates have been recovered. |
33
|
2. Fifteen percent shall be distributed to the March of |
34
|
Dimes Florida Chapter. |
35
|
3. Ten percent shall be distributed to the Florida |
36
|
Association of Healthy Start Coalitions. |
37
|
4. Twenty-five percent shall be distributed as grants for |
38
|
programs that provide research, care, and treatment for sickle |
39
|
cell disease. |
40
|
5. Twenty percent shall be distributed to programs that |
41
|
provide relief for poverty, hunger, and homelessness as follows: |
42
|
five percent to the Community Partnership for Homeless, Inc., |
43
|
Miami, Florida; five percent to the I.M. Sulzbacher Center for |
44
|
the Homeless, Inc., Jacksonville, Florida; five percent to the |
45
|
Anthony House for the Homeless, Zellwood, Florida; and five |
46
|
percent to the Homeless Emergency Project, Inc., Clearwater, |
47
|
Florida. |

6. Five percent shall be expended by the Dream Foundation, |
49
|
Inc., for administrative costs directly associated with the |
50
|
foundation's operations as they relate to the programs described |
51
|
in this paragraph. |

|
(40) UNITY LICENSE PLATES.-- |
53
|
(a) The department shall develop a UNITY license plate as |
54
|
provided in this section. The word "Florida" must appear at the |
55
|
top of the plate, and the word "UNITY" must appear at the bottom |
56
|
of the plate. |

|
(b) The annual use fees shall be distributed to the |
58
|
British-American Foundation, Inc. Up to 25 percent of such funds |
59
|
shall be used for marketing and promotion of the "UNITY" concept |
60
|
and license plate. The remaining funds shall be used in the |
61
|
following manner:
|

|
1. Twenty-five percent shall be used to establish and |
63
|
administer advice centers that will provide informative and |
64
|
educational informational materials and referral services to |
65
|
assist recently arrived residents, prospective residents, and |
66
|
individuals in adapting to living, working, and doing business |
67
|
in the State of Florida, particularly to prevent fraudulent |
68
|
conduct. |

|
2. Twenty percent shall be distributed as grants, as |
70
|
determined by an internal review committee, to organizations |
71
|
whose efforts are specifically directed toward protecting |
72
|
Florida residents from fraudulent business practices, corporate |
73
|
scams, identity theft, and other fraud. |

|
3. Ten percent shall be distributed to identified agencies |
75
|
to assist them with efforts that are specifically directed |
76
|
toward providing Florida residents with a toll-free hotline to |
77
|
fight fraud and corporate scams. |

|
4. Ten percent shall be used to pay the cost of |
79
|
professional staff who will administer advice and guidance to |
80
|
protect Florida residents from fraudulent business practices, to |
81
|
promote ethical business practices, and to provide informational |
82
|
seminars disseminating information and materials to prevent |
83
|
fraudulent conduct. |

|
5. Ten percent shall be expended by the British-American |
85
|
Foundation, Inc., for administrative costs directly associated |
86
|
with the foundation's operations as they relate to its goals of |
87
|
fighting fraud.

|
Section 3. If any law amended by this act was also amended |
89
|
by a law enacted at the 2003 Regular Session of the Legislature, |
90
|
such laws shall be construed as if they had been enacted at the |
91
|
same session of the Legislature, and full effect shall be given |
92
|
to each if possible. |

|
Section 4. This act shall take effect July 1, 2003. |
