11  Senator Campbell moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 149, between lines 20 and 21,
15  
16  insert:  
17         Section 74.  Section 624.156, Florida Statutes, is
18  created to read:
19         624.156  Applicability of consumer protection laws to
20  the business of insurance.--
21         (1)  Notwithstanding any provision of law to the
22  contrary, the business of insurance shall be subject to the
23  laws of this state applicable to any other business,
24  including, but not limited to, the Florida Civil Rights Act of
25  1992 set forth in part I of chapter 760, the Florida Antitrust
26  Act of 1980 set forth in chapter 542, the Florida Deceptive
27  and Unfair Trade Practices Act set forth in part II of chapter
28  501, and the consumer protection provisions contained in
29  chapter 540.  The protections afforded consumers by chapters
30  501, 540, 542, and 760 shall apply to insurance consumers.
31         (2)  Nothing in this section shall be construed to

SENATE AMENDMENT Bill No. CS for SB 2-B Amendment No. ___ Barcode 241902 1 prohibit: 2 (a) Any agreement to collect, compile, and disseminate 3 historical data on paid claims or reserves for reported 4 claims, provided such data is contemporaneously transmitted to 5 the Office of Insurance Regulation and made available for 6 public inspection. 7 (b) Participation in any joint arrangement established 8 by law or the Office of Insurance Regulation to assure 9 availability of insurance. 10 (c) Any agent or broker, representing one or more 11 insurers, from obtaining from any insurer such agent or broker 12 represents information relative to the premium for any policy 13 or risk to be underwritten by that insurer. 14 (d) Any agent or broker from disclosing to an insurer 15 the agent or broker represents any quoted rate or charge 16 offered by another insurer represented by that agent or broker 17 for the purpose of negotiating a lower rate, charge, or term 18 from the insurer to whom the disclosure is made. 19 (e) Any agents, brokers, or insurers from using, or 20 participating with multiple insurers or reinsurers for 21 underwriting, a single risk or group of risks. 22 23 (Redesignate subsequent sections.) 24 25 26 ================ T I T L E A M E N D M E N T =============== 27 And the title is amended as follows: 28 On page 16, line 18, after the semicolon, 29 30 insert: 31 creating s. 624.156, F.S.; providing that 2 7:24 PM 06/17/03 s0002Bc1c-32e2g
