14 On page 149, between lines 20 and 21,

16 insert:
17 Section 74. Paragraph (a) of subsection (3) of section
18 766.209, Florida Statutes, is amended to read:
19 766.209 Effects of failure to offer or accept
20 voluntary binding arbitration.--
21 (3) If the defendant refuses a claimant's offer of
22 voluntary binding arbitration:
23 (a) The claim shall proceed to trial without
24 limitation on damages, and the claimant, upon proving medical
25 negligence, shall be entitled to recover prejudgment interest,
26 and reasonable attorney's fees up to 25 percent of the award
27 reduced to present value.
