14 On page 132, between lines 7 and 8,

16 insert:
17 (3) Notwithstanding any law to the contrary, the caps
18 on noneconomic damages provided in subsection (1) of this
19 section do not apply to any incident involving a physician or
20 osteopathic physician who is not in compliance with the
21 financial responsibility requirements set forth in sections
22 458.320(1)(a), (b), (c), 458.320(2)(a), (b), (c),
23 459.0085(1)(a), (b), (c), or 459.0085(2)(a), (b), (c), Florida
24 Statutes, respectively.
