act in pari materia with laws enacted during the 2003 |

Regular Session or the 2003 Special Session A of the |

Legislature; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

Section 1. This act shall be known by the popular name the |
|
13
|
"Dori Slosberg Safety Belt Law." |
|
14
|
Section 2. Subsection (8) of section 316.614, Florida |
|
15
|
Statutes, is amended to read: |
|

|
316.614 Safety belt usage.-- |
|
17
|
(8) Any person who violates the provisions of this section |
|
18
|
commits a nonmoving violation, punishable as provided in chapter |
|
19
|
318. However, except for violations of s. 316.613, enforcement |
|
20
|
of this section by state or local law enforcement agencies must |
|
21
|
be accomplished only as a secondary action when a driver of a |
|
22
|
motor vehicle has been detained for a suspected violation of |
|
23
|
another section of this chapter, chapter 320, or chapter 322. |
|

|
Section 3. If any law amended by this act was also amended |
|
25
|
by a law enacted at the 2003 Regular Session of the Legislature |
|
26
|
or at the 2003 Special Session A of the Legislature, such laws |
|
27
|
shall be construed as if they had been enacted at the same |
|
28
|
session of the Legislature, and full effect shall be given to |
|
29
|
each if possible. |

Section 4. This act shall take effect upon becoming a law. |
