16	Section 38. Section 766.1185, Florida Statutes, is created
17	to read:
18	766.1185 Applicability of limits on noneconomic damages.--
19	(1) Beginning July 1, 2004, the limits established in s.
20	766.118 shall not apply to health care professionals licensed
21	under chapter 458 who do not meet the financial responsibility
22	requirements provided in s. 458.320(1) and health care
23	professionals licensed under chapter 459 who do not meet the
24	financial responsibility requirements provided in s.
25	459.0085(1), and damages recoverable under s. 766.118 shall not
26	be limited.
