Section 46. Notwithstanding any other provision of law to |

the contrary, in any medical malpractice injury claim involving |
18
|
a contingency fee, the claimant is entitled to receive no less |
19
|
than 70 percent of the first $250,000 of the total amount of |
20
|
damages, exclusive of reasonable and customary costs, determined |
21
|
by judgment, settlement, or otherwise and regardless of the |
22
|
number of defendants. The claimant is entitled to 100 percent of |
23
|
all such damages.
