14          Amendment (with title amendment)
15          Remove lines 1834 and 1835, and insert:
16          other noneconomic damages resulting from such occurrence shall
17    not exceed $250,000, regardless of the number of defendants
18    involved in the action, unless the jury determines that there is
19    substantial or permanent loss or impairment of a bodily
20    function, substantial disfigurement, or other special
21    circumstances in the case that warrant a finding that imposition
22    of such a limitation would deprive the claimant of just
23    compensation for the injuries sustained. The amount of such
24    limitation shall increase annually on January 1 of each year
25    based upon the increase, if any, of the consumer price index.
26    The "consumer price index" for purposes of this section means
27    the most comprehensive indexes of consumer prices for this state
28    from the Bureau of Labor Statistics of the United States
29    Department of Labor.
