15          Remove line(s) 1827-1835, and insert:
16          766.118 Determination of noneconomic damages.--
17          (1) Except as provided in subsection (2), in an action for
18    damages for medical malpractice, the noneconomic damages awarded
19    to each plaintiff in a personal injury action or each statutory
20    survivor under s. 768.21 in a wrongful death action, as applied
21    to each defendant who is a party to the action, shall not exceed
22    $850,000.
23          (2) In an action for damages for medical malpractice, the
24    limitation on noneconomic damages set forth in subsection (1)
25    shall not apply:
26          (a) To an action in which the conduct of the defendant is
27    determined to constitute gross negligence, or reckless, willful
28    or wanton conduct.
29          (b) Where the jury determines that there is a substantial
30    or permanent loss or impairment of a bodily function or
31    substantial disfigurement, in a wrongful death action where the
32    limitation on noneconomic damages would deprive the survivor of
33    fair compensation, or other special circumstances in the case
34    which warrant an award in excess of the limitations set forth in
35    subsection (1).
36          (3) The Chief Financial Officer shall adjust the
37    limitation on noneconomic damages by an amount determined at the
38    end of each calendar year to reflect the cumulative annual
39    percentage change in the consumer price index. As used in this
40    subsection, “consumer price index” shall mean the most
41    comprehensive index of consumer prices available for this state
42    from the Bureau of Labor Statistics of the U.S. Department of
43    Labor.
44          (4) The court shall instruct the jury that in the event
45    they find a defendant liable, they shall not award any plaintiff
46    or survivor more than $850,000 against any one defendant for
47    noneconomic damages unless the jury determines a higher award is
48    justified based upon the criteria set forth in subsection (2).
