12          Representative Joyner, Galvano, and Seiler offered the
13    following:

15          Amendment
16          Remove line(s) 1757-1768, and insert:
17          (a) Whether the insurer demonstrated a reasonable
18    willingness to settle with the claimant in a prompt manner;
19          (b) Whether the insurer considered the advice of its
20    defense counsel and the advice of independent counsel
21    representing solely the interests of the insured;
22          (c) Whether the insurer properly investigated and
23    evaluated the claim;
24          (d) Whether the insurer timely and fully advised the
25    insured of all offers to settle, the right to retain personal
26    counsel, and the probably outcome and risks of litigation;
27          (e) Whether the insured denied liability or requested that
28    the case be defended after the insurer fully advised the insured
29    as to the facts and the risks;
30          (f) Whether the conditions for settlement imposed by the
31    claimant, other than tender of the policy limits, were
32    reasonable;
33          (g) Whether a reasonable person who was facing the
34    prospect of paying the entire loss would have settled the claim
35    within policy limits;
36          (h) Whether the insurer puts its own interests or anyone
37    else's interests above the interests of the insured;
38          (i) Whether there was a potential for damages to exceed
39    policy limits.
