15 On page 3, between lines 16 and 17,

17 insert:
18 Section 2. (1) Beginning with the 2002-2003 school
19 year and notwithstanding sections 1008.22, 1008.25, and
20 1003.43(9), Florida Statutes, a student may not be subject to
21 mandatory retention or denied a standard high school diploma
22 on the basis of the student's scores on the Florida
23 Comprehensive Assessment Test (FCAT) until the criterion in
24 subsection (2) is met.
25 (2) The median scaled score of each subgroup of
26 students taking the FCAT within each grade level may not vary
27 from the median scaled score of any other subgroup within that
28 grade level by greater than 10 percent.
29 (3) For purposes of this section, subgroups consist
30 of:
31 (a) Economically disadvantaged students;

1 (b) White students;
2 (c) Black students;
3 (d) Hispanic students;
4 (e) Asian students;
5 (f) American Indian students;
6 (g) Students with disabilities; and
7 (h) Limited English-proficient students.

9 Notwithstanding the provisions of this section, no student who
10 has failed to attain minimum required scores on the FCAT may
11 receive a standard high school diploma unless the student has
12 taken the grade 10 FCAT at least four times prior to the
13 student's scheduled high school graduation or unless the
14 student meets the statutory requirements of another exemption
15 from taking the grade 10 FCAT.
16 Section 3. Beginning with the 2002-2003 school year,
17 the State Board of Education shall annually report, no later
18 than December 31, to the President of the Senate, the Speaker
19 of the House of Representatives, and the chairs of the
20 appropriate substantive committees, the results of the Florida
21 Comprehensive Assessment Test for all of the following
22 subgroups of students taking the test at all grade levels:
23 (1) Economically disadvantaged students;
24 (2) White students;
25 (3) Black students;
26 (4) Hispanic students;
27 (5) Asian students;
28 (6) American Indian students;
29 (7) Students with disabilities; and
30 (8) Limited English-proficient students.

18 Board of Education to report to the
19 Legislature;
