1 A bill to be entitled
2          An act relating to engineering; amending s. 471.003, F.S.;
3    exempting certain entities and persons working in the
4    defense, space, or aerospace industries from the
5    requirement to be licensed under ch. 471, F.S., as a
6    licensed engineer; amending s. 471.031, F.S.; revising a
7    prohibition on the use of certain names and titles to
8    include reference to such exemption; providing penalties;
9    providing for construction of the act in pari materia with
10    laws enacted during the 2003 Regular Session or any 2003
11    special session of the Legislature; providing an effective
12    date.
13         
14          Be It Enacted by the Legislature of the State of Florida:
15         
16          Section 1. Paragraph (j) is added to subsection (2) of
17    section 471.003, Florida Statutes, to read:
18          471.003 Qualifications for practice; exemptions.--
19          (2) The following persons are not required to be licensed
20    under the provisions of this chapter as a licensed engineer:
21          (j) Any defense, space, or aerospace company, whether a
22    sole proprietorship, firm, limited liability company,
23    partnership, joint venture, joint stock association,
24    corporation, or other business entity, subsidiary, or affiliate
25    or any employee, contract worker, subcontractor, or independent
26    contractor providing engineering for aircraft, space launch
27    vehicles, launch services, satellites, satellite services, or
28    other defense, space, or aerospace related product or services
29    or components thereof.
30          Section 2. Section 471.031, Florida Statutes, is amended
31    to read:
32          471.031 Prohibitions; penalties.--
33          (1) A person may not:
34          (a) Practice engineering unless the person is licensed
35    under this chapter.;
36          (b) Use the name or title "professional engineer" or any
37    other title, designation, words, letters, abbreviations, or
38    device tending to indicate that such person holds an active
39    license as an engineer when the person is not licensed under
40    this chapter, including, but not limited to, the following
41    titles: "agricultural engineer," "air-conditioning engineer,"
42    "architectural engineer," "building engineer," "chemical
43    engineer," "civil engineer," "control systems engineer,"
44    "electrical engineer," "environmental engineer," "fire
45    protection engineer," "industrial engineer," "manufacturing
46    engineer," "mechanical engineer," "metallurgical engineer,"
47    "mining engineer," "minerals engineer," "marine engineer,"
48    "nuclear engineer," "petroleum engineer," "plumbing engineer,"
49    "structural engineer," "transportation engineer," "software
50    engineer," "computer hardware engineer," or "systems engineer."
51    However, any person who is exempt from licensure under s.
52    471.003(2)(j) may use the title or personnel classification of
53    "engineer" in the scope of his or her work under that exemption
54    so long as that title does not include or connote the term
55    "professional engineer," "registered engineer," "licensed
56    engineer," "registered professional engineer," or licensed
57    professional engineer.";
58          (c) Present as his or her own the license of another.;
59          (d) Give false or forged evidence to the board or a member
60    thereof.;
61          (e) Use or attempt to use a license that has been
62    suspended, revoked, or placed on inactive or delinquent status.;
63          (f) Employ unlicensed persons to practice engineering.; or
64          (g) Conceal information relative to violations of this
65    chapter.
66          (2) Any person who violates any provision of this section
67    commits a misdemeanor of the first degree, punishable as
68    provided in s. 775.082 or s. 775.083.
69          Section 3. If any law amended by this act was also amended
70    by a law enacted at the 2003 Regular Session or any 2003 special
71    session of the Legislature, such laws shall be construed as if
72    they had been enacted at the same session of the Legislature,
73    and full effect shall be given to each if possible.
74          Section 4. This act shall take effect October 1, 2003.
