1 A bill to be entitled
2          An act relating to pugilistic exhibitions; providing a
3    popular name; amending s. 548.006, F.S.; requiring any
4    amateur boxing, kickboxing, or mixed martial arts match
5    held in this state to be sanctioned by a sanctioning body
6    approved by the Florida State Boxing Commission; providing
7    restrictions on such approval; amending s. 548.007, F.S.,
8    relating to applicability of ch. 548, F.S., to amateur
9    matches and certain other matches or events, to conform;
10    amending s. 548.008, F.S.; increasing the penalties for
11    participating in or promoting a professional or amateur
12    toughman or badman match; establishing a commission to
13    study the possibility of creating an oversight committee
14    responsible for the approval of sanctioning bodies
15    required under ch. 548, F.S.; providing for membership,
16    organization, and meetings; authorizing per diem and
17    reimbursement for travel expenses in the conduct of
18    official business; requiring a report; providing for
19    termination of the commission upon submission of the
20    report; providing for construction of the act in pari
21    materia with laws enacted during the 2003 Regular Session
22    or any 2003 special session of the Legislature; providing
23    an effective date.

25          Be It Enacted by the Legislature of the State of Florida:
26         
27          Section 1. This act shall be known by the popular name the
28    "Stacy Young Act."
29          Section 2. Subsection (4) is added to section 548.006,
30    Florida Statutes, to read:
31          548.006 Power of commission to control pugilistic contests
32    and exhibitions; certification of competitiveness of mixed
33    martial arts and kickboxing matches.--
34          (4) Any amateur boxing, kickboxing, or mixed martial arts
35    match held in this state must be sanctioned by a sanctioning
36    body approved by the commission. The commission may not approve
37    any sanctioning body whose sanctioning requirements are less
38    stringent than those of USA Boxing.
39          Section 3. Section 548.007, Florida Statutes, is amended
40    to read:
41          548.007 Applicability of act to amateur matches and
42    certain other matches or events.--With the exception of ss.
43    548.006(4) and s.548.008, ss. 548.001-548.079 do not apply to:
44          (1) Any match in which the participants are amateurs;
45          (2) Any match conducted or sponsored by a university,
46    college, or secondary school if all the participants are
47    students regularly enrolled in the institution;
48          (3) Any match conducted or sponsored by a nationally
49    chartered veterans' organization registered with the state;
50          (4) Any match conducted or sponsored by any company or
51    detachment of the Florida National Guard; or
52          (5) Any official Olympic event.
53          Section 4. Subsection (2) of section 548.008, Florida
54    Statutes, is amended to read:
55          548.008 Toughman and badman competition prohibited.--
56          (2) Any person participating in or promoting a
57    professional or amateur toughman or badman match commits is
58    guilty of a felony misdemeanor of the third seconddegree,
59    punishable as provided in s. 775.082, or s. 775.083, or s.
60    775.084.
61          Section 5. There is established a commission to study the
62    possibility of creating an oversight committee responsible for
63    the approval of sanctioning bodies required under chapter 548,
64    Florida Statutes. The commission shall consist of 11 members, of
65    whom the Governor shall appoint four members, the President of
66    the Senate shall appoint three members, and the Speaker of the
67    House of Representatives shall appoint three members. The chair
68    of the Florida State Boxing Commission shall be an ex officio,
69    voting member and the chair of the study commission. The
70    appointees should be broadly representative of the leading
71    combative competition organizations and governing bodies, such
72    as USA Boxing, Golden Gloves, International Kickboxing
73    Federation, International Sport Combat Federation, and the
74    Olympic Committee. The commission shall meet as soon as possible
75    after the effective date of this act to organize and conduct its
76    business and may meet subsequently at the call of the chair. Six
77    members shall constitute a quorum and the concurrence of four
78    members is necessary for official action. Members of the
79    commission may receive per diem and be reimbursed for travel
80    expenses as provided in s. 112.061, Florida Statutes, in the
81    conduct of official business. The commission shall report its
82    findings by February 2, 2004, to the Governor, the President of
83    the Senate, and the Speaker of the House of Representatives and
84    shall expire upon the submission of its report.
85          Section 6. If any law amended by this act was also amended
86    by a law enacted at the 2003 Regular Session or any 2003 special
87    session of the Legislature, such laws shall be construed as if
88    they had been enacted at the same session of the Legislature,
89    and full effect shall be given to each if possible.
90          Section 7. This act shall take effect upon becoming a law.
