| 1 | A bill to be entitled | ||
| 2 | An act relating to trust funds; creating the Entertainment | ||
| 3 | Industry Financial Incentive Trust Fund; providing for | ||
| 4 | sources of funds and purposes; providing for future review | ||
| 5 | and termination or re-creation of the trust fund; | ||
| 6 | providing an appropriation; providing an effective date. | ||

| 8 | Be It Enacted by the Legislature of the State of Florida: | ||
| 9 | |||
| 10 | Section 1. (1) The Entertainment Industry Financial | ||
| 11 | Incentive Trust Fund is created within, and shall be | ||
| 12 | administered by, the Office of Tourism, Trade, and Economic | ||
| 13 | Development. Moneys credited to the trust fund shall be those | ||
| 14 | appropriated from the General Revenue Fund or from other sources | ||
| 15 | to make incentive payments under s. 288.1254, Florida Statutes, | ||
| 16 | creating an entertainment industry financial incentive program. | ||
| 17 | The purpose of the trust fund is to facilitate the payment of | ||
| 18 | incentives under such program. | ||
| 19 | (2) In accordance with s. 19(f)(2), Art. III of the State | ||
| 20 | Constitution, the trust fund must, unless terminated sooner, be | ||
| 21 | terminated on July 1, 2008. Before its scheduled termination, | ||
| 22 | the trust fund must be reviewed as provided in s. 215.3206(1) | ||
| 23 | and (2), Florida Statutes. | ||
| 24 | Section 2. The sum of $5 million is appropriated from the | ||
| 25 | General Revenue Fund to the Entertainment Industry Financial | ||
| 26 | Incentive Trust Fund. | ||
| 27 | Section 3. This act shall take effect upon becoming a law, | ||
| 28 | but only if enacted by a three-fifths vote of the membership of | ||
| 29 | each house of the Legislature. | ||
