1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Biomedical Research Trust Fund within the
4 Department of Health without modification;
5 carrying forward current balances and
6 continuing current sources and uses thereof;
7 repealing s. 20.435(1)(h)3., F.S.; abrogating
8 provisions relating to the termination of the
9 trust fund, to conform; providing an effective
10 date.

12 WHEREAS, the Legislature wishes to extend the life of
13 the Biomedical Research Trust Fund within the Department of
14 Health, which is otherwise scheduled to be terminated pursuant
15 to constitutional mandate, and
16 WHEREAS, the Legislature has reviewed the trust fund
17 before its scheduled termination date and has found that it
18 continues to meet an important public purpose, and
19 WHEREAS, the Legislature has found that existing public
20 policy concerning the trust fund sets adequate parameters for
21 its use, NOW, THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. (1) The Biomedical Research Trust Fund
26 within the Department of Health, FLAIR number 64-2-245, which
27 is to be terminated pursuant to Section 19(f), Article III of
28 the State Constitution on July 1, 2004, is re-created.
29 (2) All current balances of the trust fund are carried
30 forward, and all current sources and uses of the trust fund
31 are continued.

1 Section 2. Subparagraph 3. of paragraph (h) of
2 subsection (1) of section 20.435, Florida Statutes, is
3 repealed.
4 Section 3. This act shall take effect July 1, 2004.
