  1                      A bill to be entitled

  2         An act relating to engineering; amending s.

  3         471.003, F.S.; exempting certain persons in the

  4         defense, space, and aerospace industries from

  5         licensure under ch. 471, F.S.; amending s.

  6         471.005, F.S.; defining the terms "space or

  7         aerospace company" and "defense company";

  8         amending s. 471.031, F.S.; clarifying that

  9         certain persons who are exempt from licensure

10         may practice engineering; clarifying which

11         professional titles such exempt persons may

12         use; providing an effective date.

13  

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (j) is added to subsection (2) of

17  section 471.003, Florida Statutes, to read:

18         471.003  Qualifications for practice; exemptions.--

19         (2)  The following persons are not required to be

20  licensed under the provisions of this chapter as a licensed

21  engineer:

22         (j)  Any defense, space, or aerospace company, whether

23  a sole proprietorship, firm, limited liability company,

24  partnership, joint venture, joint stock association,

25  corporation, or other business entity, subsidiary, or

26  affiliate, or any employee, contract worker, subcontractor, or

27  independent contractor of the defense, space, or aerospace

28  company who provides engineering for aircraft, space launch

29  vehicles, launch services, satellites, satellite services, or

30  other defense, space, or aerospace-related product or

31  services, or components thereof.

 1         Section 2.  Subsections (12) and (13) are added to

 2  section 471.005, Florida Statutes, to read:

 3         471.005  Definitions.--As used in this chapter, the

 4  term:

 5         (12)  "Space or aerospace company" means any business

 6  entity concerned with the design, manufacture, or support of

 7  aircraft, rockets, missiles, spacecraft, satellites, space

 8  vehicles, space stations, space facilities, or components

 9  thereof, and equipment, systems, facilities, simulators,

10  programs, products, services, and activities related thereto.

11         (13)  "Defense company" means any business entity that

12  holds a valid Department of Defense contract or any business

13  entity that is a subcontractor under a valid Department of

14  Defense contract. The term includes any business entity that

15  holds valid contracts or subcontracts for products or services

16  for military use under prime contracts with the United States

17  Department of Defense, the United States Department of State,

18  or the United States Coast Guard.

19         Section 3.  Subsection (1) of section 471.031, Florida

20  Statutes, is amended to read:

21         471.031  Prohibitions; penalties.--

22         (1)  A person may not:

23         (a)  Practice engineering unless the person is licensed

24  or exempt from licensure under this chapter.;

25         (b)1.  Except as provided in subparagraph 2., use the

26  name or title "professional engineer" or any other title,

27  designation, words, letters, abbreviations, or device tending

28  to indicate that such person holds an active license as an

29  engineer when the person is not licensed under this chapter,

30  including, but not limited to, the following titles:

31  "agricultural engineer," "air-conditioning engineer,"

 1  "architectural engineer," "building engineer," "chemical

 2  engineer," "civil engineer," "control systems engineer,"

 3  "electrical engineer," "environmental engineer," "fire

 4  protection engineer," "industrial engineer," "manufacturing

 5  engineer," "mechanical engineer," "metallurgical engineer,"

 6  "mining engineer," "minerals engineer," "marine engineer,"

 7  "nuclear engineer," "petroleum engineer," "plumbing engineer,"

 8  "structural engineer," "transportation engineer," "software

 9  engineer," "computer hardware engineer," or "systems

10  engineer.";

11         2.  Any person who is exempt from licensure under s.

12  471.003(2)(j) may use the title or personnel classification of

13  "engineer" in the scope of his or her work under that

14  exemption if the title does not include or connote the term

15  "professional engineer," "registered engineer," "licensed

16  engineer," "registered professional engineer," or "licensed

17  professional engineer."

18         (c)  Present as his or her own the license of another.;

19         (d)  Give false or forged evidence to the board or a

20  member thereof.;

21         (e)  Use or attempt to use a license that has been

22  suspended, revoked, or placed on inactive or delinquent

23  status.;

24         (f)  Employ nonexempt unlicensed persons to practice

25  engineering.; or

26         (g)  Conceal information relative to violations of this

27  chapter.

28         Section 4.  This act shall take effect upon becoming a

29  law.
