| 2 | A joint resolution proposing an amendment to Section 23 of | ||
| 3 | Article I of the State Constitution to limit the | ||
| 4 | application to minors of the constitutional right to | ||
| 5 | privacy and any other provisions of the state constitution | ||
| 6 | to the extent such application would limit the rights or | ||
| 7 | authority of parents or legal guardians provided by law or | ||
| 8 | would limit the authority of the government to secure such | ||
| 9 | rights of parents or legal guardians. | ||

| 11 | Be It Resolved by the Legislature of the State of Florida: | ||
| 12 | |||
| 13 | That the amendment to Section 23 of Article I of the State | ||
| 14 | Constitution set forth below is agreed to and shall be submitted | ||
| 15 | to the electors of Florida for approval or rejection at the | ||
| 16 | general election to be held in November 2004: | ||
| 17 | ARTICLE I | ||
| 18 | DECLARATION OF RIGHTS | ||
| 19 | SECTION 23. Right of privacy.--Every natural person has | ||
| 20 | the right to be let alone and free from governmental intrusion | ||
| 21 | into the person's private life except as otherwise provided | ||
| 22 | herein. This section shall not be construed to limit the | ||
| 23 | public's right of access to public records and meetings as | ||
| 24 | provided by law. Neither this section nor any other provision | ||
| 25 | of the Constitution of Florida shall be construed with respect | ||
| 26 | to minors so as to limit the rights or authority of parents or | ||
| 27 | legal guardians as otherwise provided by law or to limit the | ||
| 28 | authority of the government to advance or secure such rights or | ||
| 29 | authority of parents or legal guardians. | ||
| 30 | BE IT FURTHER RESOLVED that the title and substance of the | ||
| 31 | amendment proposed herein shall appear on the ballot as follows: | ||
| 32 | PARENTAL RIGHTS | ||
| 33 | Proposes an amendment to Section 23 of Article I of the | ||
| 34 | State Constitution to limit the application to minors of the | ||
| 35 | constitutional right to privacy and any other provisions of the | ||
| 36 | state constitution to the extent such application would limit | ||
