11  Senator Diaz de la Portilla moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         Delete everything after the resolving clause
15  
16  and insert:  
17         That the following creation of Section 22 of Article X
18  of the State Constitution is agreed to and shall be submitted
19  to the electors of this state for approval or rejection at the
20  general election to be held in November 2004:
21                            ARTICLE X
22                          MISCELLANEOUS
23         SECTION 22.  Parental notice of termination of a
24  minor's pregnancy.--The Legislature shall not limit or deny
25  the privacy right guaranteed to a minor under the United
26  States Constitution as interpreted by the United States
27  Supreme Court. Notwithstanding a minor's right of privacy
28  provided in Section 23 of Article I, the Legislature is
29  authorized to require by general law for notification to a
30  parent or guardian of a minor before the termination of the
31  minor's pregnancy. The Legislature shall provide exceptions to

 1  such requirement for notification and shall create a procedure
 2  for judicial waiver of the notification.
 3         BE IT FURTHER RESOLVED that the following statement be
 4  placed on the ballot:
 5                     CONSTITUTIONAL AMENDMENT
 6                      ARTICLE X, SECTION 22
 7         PARENTAL NOTIFICATION OF A MINOR'S TERMINATION OF
 8  PREGNANCY.--Proposing an amendment to the State Constitution
 9  to authorize the Legislature to require by general law for
10  notification to a parent or guardian of a minor before the
11  termination of the minor's pregnancy. The amendment provides
12  that the Legislature shall not limit or deny the privacy
13  rights guaranteed to minors under the United States
14  Constitution as interpreted by the United States Supreme
15  Court. The Legislature shall provide exceptions to such
16  requirement for notification and shall create a procedure for
17  judicial waiver of the requirement for notification.
