House Joint Resolution
2A joint resolution proposing the creation of Section 22 of
3Article X of the State Constitution, relating to
4miscellaneous matters, prohibiting the Legislature from
5limiting or denying the privacy right guaranteed to a
6minor under the United States Constitution, as interpreted
7by the United States Supreme Court, and authorizing the
8Legislature to enact Legislation providing for the
9notification of a pregnant minor's parent or guardian
10before termination of the pregnancy and setting
11requirements and conditions therefor.

13Be It Resolved by the Legislature of the State of Florida:

15     That the following creation of Section 22 of Article X of
16the State Constitution is agreed to and shall be submitted to
17the electors of this state for approval or rejection at the
18general election to be held in November 2004:

MISCELLANEOUS
21     SECTION 22.  Parental notice of termination of a minor's
22minor's pregnancy.--The legislature shall not limit or deny
23the privacy right guaranteed to a minor under the United States
24Constitution as interpreted by the United States Supreme Court.
25Notwithstanding a minor's right of privacy provided in Section
2623 of Article I, the Legislature is authorized to require by
27general law for notification to a parent or guardian of a minor
28before the termination of the minor's pregnancy. The Legislature
29shall provide exceptions to such requirement for notification
30and shall create a process for judicial waiver of the
31notification.
32     BE IT FURTHER RESOLVED that the following statement be
33placed on the ballot:

ARTICLE X, SECTION 22
36     PARENTAL NOTIFICATION OF A MINOR'S TERMINATION OF
37PREGNANCY.--Proposing an amendment to the State Constitution to
38authorize the Legislature to require by general law for
39notification to a parent or guardian of a minor before the
40termination of the minor's pregnancy. The amendment provides
41that the Legislature shall not limit or deny the privacy rights
42guaranteed to minors under the United States Constitution as
43interpreted by the United States Supreme Court. The Legislature
44shall provide exceptions to such requirement for notification
45and shall create a process for judicial waiver of the
46requirement for notification.
