3     Amendment (with title amendment)
4     Between line(s) 259 and 260, insert:
5     Section 5.  Paragraph (c) of subsection (4) and paragraph
6(a) of subsection (5) of section 489.133, Florida Statutes, are
7amended to read:
8     489.133  Pollutant storage systems specialty contractors;
9definitions; certification; restrictions.--
10     (4)  The board shall adopt rules providing standards for
11certification of pollutant storage systems specialty
12contractors, including persons who remove such systems. The
13board shall provide the proposed rules to the Department of
14Environmental Protection for review and comment prior to
15adoption. The rules shall include, but not be limited to:
16     (c)  Requirements for certification without examination of
17pollutant storage systems specialty contractors for any person
18who has passed a local licensure examination, a licensure
19examination in another state, or a licensure examination of a
20national organization, which is at least as stringent as the
21examination adopted by the board.
22     (5)(a)  Notwithstanding any provision of this part to the
23contrary, no person shall engage in contracting as a pollutant
24storage systems specialty contractor unless such person is
25certified as a pollutant storage systems specialty contractor
26pursuant to this part, and if the person installs or removes a
27petroleum storage system as defined in s. 376.301(33), that
28person must comply with the requirements of s. 376.30711(2)(b)
29and (c), and maintain pollution liability insurance of at least
30$1 million per occurrence and $1 million annual aggregate, nor
31shall any official authorized to issue building or other related
32permits issue a permit or permits for the installation or
33removal of a pollutant storage tank unless such official
34ascertains that the applicant for such permit or permits is
35certified as a pollutant storage systems specialty contractor
36and that the applicant satisfies the requirements imposed by
37this paragraph.
