1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Florida Forever Program Trust Fund within the
4 Department of Community Affairs without
5 modification; carrying forward current balances
6 and continuing current sources and uses
7 thereof; repealing s. 380.5115(3), F.S.;
8 abrogating provisions relating to the
9 termination of the trust fund, to conform;
10 providing an effective date.

12 WHEREAS, the Legislature wishes to extend the life of
13 the Florida Forever Program Trust Fund within the Department
14 of Community Affairs, which is otherwise scheduled to be
15 terminated pursuant to constitutional mandate, and
16 WHEREAS, the Legislature has reviewed the trust fund
17 before its scheduled termination date and has found that it
18 continues to meet an important public purpose, and
19 WHEREAS, the Legislature has found that existing public
20 policy concerning the trust fund sets adequate parameters for
21 its use, NOW, THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:

25 Section 1. (1) The Florida Forever Program Trust Fund
26 within the Department of Community Affairs, FLAIR number
27 52-2-349, which is to be terminated pursuant to Section 19(f),
28 Article III of the State Constitution on November 4, 2004, is
29 re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. Subsection (3) of section 380.5115, Florida
5 Statutes, is repealed.
6 Section 3. This act shall take effect November 4,
7 2004.
