3     Substitute Amendment for Amendment (138153) (with title
4amendment)
5Remove lines 79-80 and insert:
6     Section 3.  (1)  Notwithstanding any other law,
7instructional personnel, as defined in s. 1012.01(2), Florida
8Statutes, employed by a developmental research school or the
9Florida School for the Deaf and the Blind are eligible for
10reemployment after retirement in the same manner as classroom
11teachers who are employed by the district school boards, as
12described in ss. 121.091(9)(b)3. and 238.181(2)(c), Florida
13Statutes.
14     (2)  Instructional personnel, as defined in s. 1012.01(2),
15Florida Statutes, employed by a developmental research school
16and authorized by the school's director, or if the school has no
17director, by the school's principal, are eligible for the
18Deferred Retirement Option Program (DROP) beyond 60 months in
19the same manner as the instructional personnel who are employed
20by the district school boards and authorized by the district
21school superintendent, as described in s. 121.091(13), Florida
22Statutes.
23     Section 4.  Effective July 1, 2004, the director or
24principal of a charter school participating in the Florida
25Retirement System may reemploy a retired member as a substitute
26or hourly teacher on a noncontractual basis, or reemploy such
27retired member as instructional personnel, as defined in s.
281012.01(2)(a), Florida Statutes, on an annual contractual basis,
29after he or she has been retired for 1 calendar month in
30accordance with s. 121.021(39), Florida Statutes.
31     Section 5.  This act shall take effect upon becoming a law
32and sections 1 and 2 of this act shall apply retroactively to
33July 1, 2003.

38retirement benefits are available to instructional personnel
39employed by developmental research schools and the Florida
40School for the Deaf and the Blind; authorizing the director or

42teachers under certain circumstances; providing an effective
43date.
