5 | Section 7. Subsections (2) and (3) of section 186.504, |
6 | Florida Statutes, are amended to read: |
7 | 186.504 Regional planning councils; creation; |
8 | membership.-- |
9 | (2) Membership on the regional planning council shall be |
10 | as follows: |
11 | (a) Representatives appointed by each of the member |
12 | counties in the geographic area covered by the regional planning |
13 | council. |
14 | (b) Representatives from other member local general- |
15 | purpose governments in the geographic area covered by the |
16 | regional planning council. |
17 | (c) Representatives appointed by the Governor from the |
18 | geographic area covered by the regional planning council, |
19 | including an elected school board member from the geographic |
20 | area covered by the regional planning council, to be nominated |
21 | by the Florida School Board Association. |
22 | (d) For those regional planning councils within the South |
23 | Florida Regional Transportation Authority service territory, a |
24 | representative appointed by the South Florida Regional |
25 | Transportation Authority. |
26 | (3) Not less than two-thirds of the representatives |
27 | serving as voting members on the governing bodies of such |
28 | regional planning councils shall be elected officials of local |
29 | general-purpose governments chosen by the cities and counties of |
30 | the region, provided each county shall have at least one vote. |
31 | The remaining one-third of the voting members on the governing |
32 | board shall be appointed by the Governor, to include one elected |
33 | school board member, subject to confirmation by the Senate, and |
34 | shall reside in the region. No two appointees of the Governor |
35 | shall have their places of residence in the same county until |
36 | each county within the region is represented by a Governor's |
37 | appointee to the governing board. Nothing contained in this |
38 | section shall deny to local governing bodies or the Governor the |
39 | option of appointing either locally elected officials or lay |
40 | citizens provided at least two-thirds of the governing body of |
41 | the regional planning council is composed of locally elected |
42 | officials. In those regional planning councils within the South |
43 | Florida Regional Transportation's service territory, the voting |
44 | member representing the South Florida Regional Transportation |
45 | Authority shall not be subject to the above referenced ratios |
46 | regarding board composition. |
47 | Section 8. Paragraph (b) of subsection (1) of section |
48 | 343.54, Florida Statutes, is amended to read: |
49 | 343.54 Powers and duties.-- |

51 | (b) It is the express intention of this part that the |
52 | authority be authorized to plan, develop, own, purchase, lease, |
53 | or otherwise acquire, demolish, construct, improve, relocate, |
54 | equip, repair, maintain, operate, and manage a transit system |
55 | and transit facilities; to establish and determine the policies |
56 | necessary for the best interest of the operation and promotion |
57 | of a transit system; and to adopt rules necessary to govern the |
58 | operation of a transit commuter rail system and transit commuter |
59 | rail facilities. It is the intent of the Legislature that the |
60 | South Florida Regional Transportation Authority shall have |
61 | overall authority to coordinate, develop, and operate a regional |
62 | transportation system within the area served. |
63 | Section 9. Section 343.58, Florida Statutes, is amended to |
64 | read: |
65 | 343.58 County funding for the South Florida Regional |
66 | Transportation Authority.-- |
67 | (1) Each county served by the South Florida Regional |
68 | Transportation Authority must dedicate and transfer not less |
69 | than $2.67 million to the authority annually. The recurring |
70 | annual $2.67 million must be dedicated by the governing body of |
71 | each county prior to October 31 of each fiscal year by August 1, |
72 | 2003. Notwithstanding ss. 206.41 and 206.87, such dedicated |
73 | funding may come from each county's share of the ninth-cent fuel |
74 | tax, the local option fuel tax, or any other source of local gas |
75 | taxes or other nonfederal funds available to the counties. In |
76 | addition, the Legislature authorizes the levy of an annual |
77 | license tax in the amount of $2 for the registration or renewal |
78 | of registration of each vehicle taxed under s. 320.08 and |
79 | registered in the area served by the South Florida Regional |
80 | Transportation Authority. The annual license tax shall take |
81 | effect in any county served by the authority upon approval by |
82 | the residents in a county served by the authority. The annual |
83 | license tax shall be levied and the Department of Highway Safety |
84 | and Motor Vehicles shall remit the proceeds each month from the |
85 | tax to the South Florida Regional Transportation Authority. |
86 | (2) In addition, each county shall continue to annually |
87 | fund the operations of the South Florida Regional Transportation |
88 | Authority in an amount not less than $1.565 million. Such funds |
89 | pursuant to this subsection shall also be considered a dedicated |
90 | funding source. |

92 | If, by December 31, 2009, the South Florida Regional |
93 | Transportation Authority has not received federal matching funds |
94 | based upon the dedication of funds under subsection (1), |
95 | subsection (1) shall be repealed. |
