3     Amendment (with title amendment)
4     Between lines 534 and 535 insert:
5     Section 7.  Sections 7-9 of this act shall be known by the
6popular name the "Dori Slosberg Safety Belt Law."
7     Section 8.  Subsections (8) and (9) of section 316.614,
8Florida Statutes, are amended to read:
9     316.614  Safety belt usage.--
10     (8)  Any person who violates the provisions of this section
11commits a nonmoving violation, punishable as provided in chapter
12318. However, except for violations of s. 316.613, enforcement
13of this section by state or local law enforcement agencies must
14be accomplished only as a secondary action when a driver of a
15motor vehicle has been detained for a suspected violation of
16another section of this chapter, chapter 320, or chapter 322.
17     (9)(a)  A violation of the provisions of this section shall
18not constitute negligence per se, nor shall such violation be
19used as prima facie evidence of negligence or be considered in
20mitigation of damages, but such violation may be considered as
21evidence of comparative negligence, in any civil action.
22     (b)  As in any other violation of this chapter, a vehicle,
23the contents of a vehicle, the driver of a vehicle, or a
24passenger in a vehicle may not be searched solely because of a
25violation of this chapter.
26     Section 9.  If by December 31, 2007, the State of Florida
27has not received a minimum of $28 million from the United States
28Department of Transportation earmarked from funds directly
29attributable to the changes made to section 316.614, Florida
30Statutes, by this act, the provisions of this act amending
31section 316.614, Florida Statutes, shall expire and revert to
32the text as it existed prior to the effective date of the
33changes made by this act.
