5 | Section 2. Notwithstanding any provision of law to the |
6 | contrary, the governing body of an inland county with a state- |
7 | designated enterprise zone and a population greater than 500,000 |
8 | may apply to the Office of Tourism, Trade, and Economic |
9 | Development to amend the boundaries of one noncontiguous area of |
10 | an enterprise zone. The office shall approve the application if |
11 | the amended area does not exceed 5 square miles and is |
12 | consistent with the categories, criteria, and limitations |
13 | imposed by section 290.0055, Florida Statutes, upon the |
14 | establishment of such enterprise zone. The application for the |
15 | amendment to the enterprise zone boundary must be received by |
16 | December 31, 2004. |
17 | Section 3. Subsection (11) of section 290.0065, Florida |
18 | Statutes, is amended, and subsections (12) and (13) are added to |
19 | said section, to read: |
20 | 290.0065 State designation of enterprise zones.-- |
21 | (11) Before December 31, 2004 June 1, 2002, the governing |
22 | body or governing bodies of a county or a municipality in that |
23 | is located within a county having a population of more than |
24 | 235,000 but less than 260,000 225,000 and in which an enterprise |
25 | zone is designated under subparagraph (3)(a)2. is located may |
26 | apply to the Office of Tourism, Trade, and Economic Development |
27 | to change the boundaries of the enterprise zone for the purpose |
28 | of replacing areas not suitable for development. The Office of |
29 | Tourism, Trade, and Economic Development shall approve the |
30 | application made pursuant to this subsection if the boundary |
31 | change is consistent with the categories, criteria, and |
32 | limitations imposed upon the establishment of such does not |
33 | increase the overall size of the enterprise zone and if any |
34 | territory added to the enterprise zone as a result of the |
35 | boundary change is contiguous to the remaining area of the |
36 | existing enterprise zone. |
37 | (12) Notwithstanding any provisions in s. 290.0055 |
38 | regarding the size of an enterprise zone, any county defined by |
39 | s. 125.011(1) may apply to the Office of Tourism, Trade, and |
40 | Economic Development by October 1, 2004, to expand the boundary |
41 | of an existing enterprise zone to include an additional 8.7 |
42 | square miles. The area must also include areas to the north or |
43 | east of the northeasternmost section of an existing enterprise |
44 | zone. The expanded area may not include any area not described |
45 | in this subsection. The Office of Tourism, Trade, and Economic |
46 | Development shall approve an amendment to the boundary of an |
47 | enterprise zone under this subsection by January 1, 2005, if the |
48 | area proposed for addition to the enterprise zone is consistent |
49 | with the criteria and conditions imposed by s. 290.0055 upon the |
50 | establishment of enterprise zones, including the requirement |
51 | that the area suffer from pervasive poverty, unemployment, and |
52 | general distress. |
53 | (13) Before November 30, 2004, any county as defined in s. |
54 | 125.011 may apply to the Office of Tourism, Trade, and Economic |
55 | Development to change the boundaries of an existing enterprise |
56 | zone for the purpose of replacing an area of not more than 75 |
57 | acres within the enterprise zone as of January 1, 2004, with an |
58 | area of the same number of acres outside the enterprise zone as |
59 | of January 1, 2004. The replacement area must be contiguous to |
60 | the existing enterprise zone and must be a part of a |
61 | revitalization area that has been targeted for assistance by the |
62 | county. The replacement area also must be contiguous to a zoo |
63 | and the county must have previously completed a master plan for |
64 | development of the area. The Office of Tourism, Trade, and |
65 | Economic Development shall approve the amendment effective |
66 | January 1, 2005, if the enterprise zone remains consistent with |
67 | the criteria and conditions imposed by s. 290.0055 upon the |
68 | establishment of enterprise zones, including the requirement |
69 | that the area suffer from pervasive poverty, unemployment, and |
70 | general distress. |
71 | Section 4. Section 290.00675, Florida Statutes, is amended |
72 | to read: |
73 | 290.00675 Amendment of certain enterprise zone |
74 | boundaries.-- |
75 | (1) Notwithstanding any other provisions of law, the |
76 | Office of Tourism, Trade, and Economic Development may amend the |
77 | boundaries of an area designated as an enterprise zone in a |
78 | community having a population of 235,000 persons but less than |
79 | 260,000, so long as the area does not increase the overall size |
80 | of the zone by greater than 25 acres and the increased area is |
81 | contiguous to the existing enterprise zone. The amendment must |
82 | also be consistent with the limitations imposed by s. 290.0055 |
83 | upon establishment of the enterprise zone. |
84 | (2) Notwithstanding any other provisions of law, the |
85 | Office of Tourism, Trade, and Economic Development may approve |
86 | requests to amend the boundaries of an area designated as an |
87 | enterprise zone in a community having a population of 50,000 |
88 | persons but fewer than 60,000, so long as the area does not |
89 | increase the overall size of the zone by greater than 400 acres |
90 | and the increased area is contiguous to the existing enterprise |
91 | zone. The amendment must also be consistent with the limitations |
92 | imposed by s. 290.0055 upon establishment of the enterprise |
93 | zone. Such request must be submitted to the Office of Tourism, |
94 | Trade, and Economic Development prior to December 31, 2004. |
95 | (3) Notwithstanding any other provision of law, the Office |
96 | of Tourism, Trade, and Economic Development may amend the |
97 | boundaries of an area designated as The City of |
98 | Brooksville/Hernando County Enterprise Zone # 2701. Hernando |
99 | County is a community having a population greater than 140,000. |
100 | The boundary amendment must not increase the overall size of the |
101 | enterprise zone by more than 5 square miles. The increased area |
102 | shall be contiguous to the existing enterprise zone. The |
103 | boundary amendment must also be consistent with the limitations |
104 | imposed by s. 290.0055. The application package for the boundary |
105 | amendment must be submitted to the Office of Tourism, Trade, and |
106 | Economic Development no later than December 31, 2004. |
107 | Section 5. Section 290.00688, Florida Statutes, is amended |
108 | to read: |
109 | 290.00688 Enterprise zone designation for Leon |
110 | County.--Leon County, or Leon County and the City of Tallahassee |
111 | Leon County, or Leon County and the City of Tallahassee jointly, |
112 | may apply to the Office of Tourism, Trade, and Economic |
113 | Development for designation of one enterprise zone, the selected |
114 | area of which shall not exceed 20 square miles and shall have a |
115 | continuous boundary, or consist of not more than three |
116 | noncontiguous areas per s. 290.0055(4)(a). The enterprise zone |
117 | shall encompass an area or areas within the following census |

169 | enterprise zones designated and the number of enterprise zones |
170 | within a population category, the Office of Tourism, Trade, and |
171 | Economic Development may designate one enterprise zone under |
172 | this section. The Office of Tourism, Trade, and Economic |
173 | Development shall establish the initial effective date of the |
174 | enterprise zone designated under this section. |
175 | Section 7. Section 290.00704, Florida Statutes, is created |
176 | to read: |
177 | 290.00704 Enterprise zone designation for the City of Lake |
178 | Wales.--The City of Lake Wales may apply to the Office of |
179 | Tourism, Trade, and Economic Development for designation of one |
180 | enterprise zone for an area within the City of Lake Wales, which |
181 | zone shall encompass an area up to 3 contiguous square miles. |
182 | The application must be submitted by December 31, 2004, and must |
183 | comply with the requirements of s. 290.0055. Notwithstanding the |
184 | provisions of s. 290.0065, limiting the total number of |
185 | enterprise zones designated and the number of enterprise zones |
186 | within a population category, the Office of Tourism, Trade, and |
187 | Economic Development may designate one enterprise zone under |
188 | this section. The Office of Tourism, Trade, and Economic |
189 | Development shall establish the initial effective date of the |
190 | enterprise zone designated pursuant to this section. |
191 | Section 8. Enterprise zone designation for Walton |
192 | County.--Walton County may apply to the Office of Tourism, |
193 | -Walton County may apply to the Office of Tourism, Trade, and |
194 | Economic Development for designation of one enterprise zone |
195 | within an area in Walton County which encompasses up to 6 square |
196 | miles. The application must be submitted by December 31, 2004, |
197 | and must comply with the requirements of section 290.0055, |
198 | Florida Statutes, except subsection (3) thereof. Notwithstanding |
199 | section 290.0065, Florida Statutes, limiting the total number of |
200 | enterprise zones designated and the number of enterprise zones |
201 | within a population category, the Office of Tourism, Trade, and |
202 | Economic Development may designate one enterprise zone under |
203 | this section. The Office of Tourism, Trade, and Economic |
204 | Development shall establish the initial effective date of the |
205 | enterprise zone designated pursuant to this section. |
206 | Section 9. Enterprise zone designation for the City of |
207 | West Miami.--Miami-Dade County or Miami-Dade County, jointly |
208 | with the City of West Miami, may apply to the Office of Tourism, |
209 | Trade, and Economic Development for designation of one |
210 | enterprise zone within the City of West Miami. The application |
211 | must be submitted by December 31, 2004, and must comply with the |
212 | requirements of section 290.0055, Florida Statutes. |
213 | Notwithstanding the provisions of section 290.0065, Florida |
214 | Statutes, limiting the total number of enterprise zones |
215 | designated and the number of enterprise zones within a |
216 | population category, the Office of Tourism, Trade, and Economic |
217 | Development may designate one enterprise zone under this |
218 | section. The Office of Tourism, Trade, and Economic Development |
219 | shall establish the initial effective date of the enterprise |
220 | zone designated under this section. |
221 | Section 10. (1) Notwithstanding the limitation in section |
222 | 290.0065, Florida Statutes, on the number of enterprise zones |
223 | within a population category, the Office of Tourism, Trade, and |
224 | Economic Development shall designate, upon joint application by |
225 | Miami-Dade County and the City of Hialeah, an area within the |
226 | municipality of the City of Hialeah in an area bounded by 32nd |
227 | Street, 21st Street, Palm Avenue, and East 4th Avenue as an |
228 | enterprise zone. The application must be submitted by June 1, |
229 | 2004, and must comply with the requirements of section 290.0055, |
230 | Florida Statutes, except for paragraph (4)(d). The effective |
231 | date of the enterprise zone is July 1, 2004. |
232 | (2) This section shall take effect upon becoming a law. |
233 | Section 11. Notwithstanding any other provision of law, a |
234 | governing body located wholly within the boundaries of a |
235 | consolidated government may apply to the Office of Tourism, |
236 | Trade, and Economic Development to amend the boundary of its |
237 | existing enterprise zone. The area proposed for addition to the |
238 | enterprise zone must include the three noncontiguous areas |
239 | designated as a federal empowerment zone under the 2000 |
240 | Community Renewal Tax Relief Act without any limitations as to |
241 | size. The Office of Tourism, Trade, and Economic Development may |
242 | approve an amendment to the enterprise zone boundary lines if |
243 | the application is submitted before December 31, 2004, and meets |
244 | the requirements of this section. |
245 | Section 12. Notwithstanding any other provision of chapter |
246 | 290, Florida Statutes, the governing body of any inland county, |
247 | with a state-designated enterprise zone and a population greater |
248 | than 500,000, may apply to the Office of Tourism, Trade, and |
249 | Economic Development to amend the boundaries of such enterprise |
250 | zone. The increased areas shall be contiguous to the existing |
251 | enterprise zone. The office shall approve the application as |
252 | long as the amended area does not exceed 5 square miles and is |
253 | consistent with the categories, criteria, and limitations |
254 | imposed by section 290.0055, Florida Statutes, upon the |
255 | establishment of such enterprise zone. The enterprise zone |
256 | boundary amendment application must be received before December |
257 | 31, 2004. |
258 | Section 13. If any provision of this act or its |
259 | application to any person or circumstance is held invalid, the |
260 | invalidity does not affect other provisions or applications of |
261 | the act which can be given effect without the invalid provision |
262 | or application, and to this end the provisions of this act are |
263 | severable. |
264 | Section 14. Except as otherwise expressly provided in this |
265 | act, this act shall take effect July 1, 2004. |
