3     Amendment (with title amendment)
4     Remove line(s) 45-79, and insert:
5     Section 2.  Notwithstanding any provision of law to the
6contrary, the governing body of an inland county with a state-
7designated enterprise zone and a population greater than 500,000
8may apply to the Office of Tourism, Trade, and Economic
9Development to amend the boundaries of one noncontiguous area of
10an enterprise zone. The office shall approve the application if
11the amended area does not exceed 5 square miles and is
12consistent with the categories, criteria, and limitations
13imposed by section 290.0055, Florida Statutes, upon the
14establishment of such enterprise zone. The application for the
15amendment to the enterprise zone boundary must be received by
16December 31, 2004.
17     Section 3.  Subsection (11) of section 290.0065, Florida
18Statutes, is amended, and subsections (12) and (13) are added to
19said section, to read:
20     290.0065  State designation of enterprise zones.--
21     (11)  Before December 31, 2004 June 1, 2002, the governing
22body or governing bodies  of a county or a municipality in that
23is located within a county having a population of more than
24235,000 but less than 260,000 225,000 and in which an enterprise
25zone is designated under subparagraph (3)(a)2. is located may
26apply to the Office of Tourism, Trade, and Economic Development
27to change the boundaries of the enterprise zone for the purpose
28of replacing areas not suitable for development. The Office of
29Tourism, Trade, and Economic Development shall approve the
30application made pursuant to this subsection if the boundary
31change is consistent with the categories, criteria, and
32limitations imposed upon the establishment of such does not
33increase the overall size of the enterprise zone and if any
34territory added to the enterprise zone as a result of the
35boundary change is contiguous to the remaining area of the
36existing enterprise zone.
37     (12)  Notwithstanding any provisions in s. 290.0055
38regarding the size of an enterprise zone, any county defined by
39s. 125.011(1) may apply to the Office of Tourism, Trade, and
40Economic Development by October 1, 2004, to expand the boundary
41of an existing enterprise zone to include an additional 8.7
42square miles. The area must also include areas to the north or
43east of the northeasternmost section of an existing enterprise
44zone. The expanded area may not include any area not described
45in this subsection. The Office of Tourism, Trade, and Economic
46Development shall approve an amendment to the boundary of an
47enterprise zone under this subsection by January 1, 2005, if the
48area proposed for addition to the enterprise zone is consistent
49with the criteria and conditions imposed by s. 290.0055 upon the
50establishment of enterprise zones, including the requirement
51that the area suffer from pervasive poverty, unemployment, and
52general distress.
53     (13)  Before November 30, 2004, any county as defined in s.
54125.011 may apply to the Office of Tourism, Trade, and Economic
55Development to change the boundaries of an existing enterprise
56zone for the purpose of replacing an area of not more than 75
57acres within the enterprise zone as of January 1, 2004, with an
58area of the same number of acres outside the enterprise zone as
59of January 1, 2004. The replacement area must be contiguous to
60the existing enterprise zone and must be a part of a
61revitalization area that has been targeted for assistance by the
62county. The replacement area also must be contiguous to a zoo
63and the county must have previously completed a master plan for
64development of the area. The Office of Tourism, Trade, and
65Economic Development shall approve the amendment effective
66January 1, 2005, if the enterprise zone remains consistent with
67the criteria and conditions imposed by s. 290.0055 upon the
68establishment of enterprise zones, including the requirement
69that the area suffer from pervasive poverty, unemployment, and
70general distress.
71     Section 4.  Section 290.00675, Florida Statutes, is amended
72to read:
73     290.00675  Amendment of certain enterprise zone
74boundaries.--
75     (1)  Notwithstanding any other provisions of law, the
76Office of Tourism, Trade, and Economic Development may amend the
77boundaries of an area designated as an enterprise zone in a
78community having a population of 235,000 persons but less than
79260,000, so long as the area does not increase the overall size
80of the zone by greater than 25 acres and the increased area is
81contiguous to the existing enterprise zone. The amendment must
82also be consistent with the limitations imposed by s. 290.0055
83upon establishment of the enterprise zone.
84     (2)  Notwithstanding any other provisions of law, the
85Office of Tourism, Trade, and Economic Development may approve
86requests to amend the boundaries of an area designated as an
87enterprise zone in a community having a population of 50,000
88persons but fewer than 60,000, so long as the area does not
89increase the overall size of the zone by greater than 400 acres
90and the increased area is contiguous to the existing enterprise
91zone. The amendment must also be consistent with the limitations
92imposed by s. 290.0055 upon establishment of the enterprise
93zone. Such request must be submitted to the Office of Tourism,
94Trade, and Economic Development prior to December 31, 2004.
95     Section 5.  Section 290.00688, Florida Statutes, is amended
96to read:
97     290.00688  Enterprise zone designation for Leon
98County.--Leon County, or Leon County and the City of Tallahassee
99Leon County, or Leon County and the City of Tallahassee jointly,
100may apply to the Office of Tourism, Trade, and Economic
101Development for designation of one enterprise zone, the selected
102area of which shall not exceed 20 square miles and shall have a
103continuous boundary, or consist of not more than three
104noncontiguous areas per s. 290.0055(4)(a). The enterprise zone
105shall encompass an area or areas within the following census
106tracts for Leon County pursuant to the 1990 Census:

139The application must be submitted by December 31, 2002, and must
140comply with the requirements of s. 290.0055. Notwithstanding the
141provisions of s. 290.0065 limiting the total number of
142enterprise zones designated and the number of enterprise zones
143within a population category, the Office of Tourism, Trade, and
144Economic Development may designate one enterprise zone under
145this section. The Office of Tourism, Trade, and Economic
146Development shall establish the initial effective date of the
147enterprise zone designated pursuant to this section.
148     Section 6.  Section 290.00703, Florida Statutes, is created
149to read:
150     290.00703  Enterprise zone designation for the City of
151South Daytona.--The City of South Daytona may apply to the
152Office of Tourism, Trade, and Economic Development for
153designation of one enterprise zone within the city. The
154application must be submitted by December 31, 2004, and must
155comply with the requirements of s. 290.0055. Notwithstanding the
156provisions of s. 290.0065 limiting the total number of
157enterprise zones designated and the number of enterprise zones
158within a population category, the Office of Tourism, Trade, and
159Economic Development may designate one enterprise zone under
160this section. The Office of Tourism, Trade, and Economic
161Development shall establish the initial effective date of the
162enterprise zone designated under this section.
163     Section 7.  Section 290.00704, Florida Statutes, is created
164to read:
165     290.00704  Enterprise zone designation for the City of Lake
166Wales.--The City of Lake Wales may apply to the Office of
167Tourism, Trade, and Economic Development for designation of one
168enterprise zone for an area within the City of Lake Wales, which
169zone shall encompass an area up to 3 contiguous square miles.
170The application must be submitted by December 31, 2004, and must
171comply with the requirements of s. 290.0055. Notwithstanding the
172provisions of s. 290.0065, limiting the total number of
173enterprise zones designated and the number of enterprise zones
174within a population category, the Office of Tourism, Trade, and
175Economic Development may designate one enterprise zone under
176this section. The Office of Tourism, Trade, and Economic
177Development shall establish the initial effective date of the
178enterprise zone designated pursuant to this section.
179     Section 8.  Enterprise zone designation for Walton
180County.--Walton County may apply to the Office of Tourism,
181-Walton County may apply to the Office of Tourism, Trade, and
182Economic Development for designation of one enterprise zone
183within an area in Walton County which encompasses up to 6 square
184miles. The application must be submitted by December 31, 2004,
185and must comply with the requirements of section 290.0055,
186Florida Statutes, except subsection (3) thereof. Notwithstanding
187section 290.0065, Florida Statutes, limiting the total number of
188enterprise zones designated and the number of enterprise zones
189within a population category, the Office of Tourism, Trade, and
190Economic Development may designate one enterprise zone under
191this section. The Office of Tourism, Trade, and Economic
192Development shall establish the initial effective date of the
193enterprise zone designated pursuant to this section.
194     Section 9.  Enterprise zone designation for the City of
195West Miami.--Miami-Dade County or Miami-Dade County, jointly
196with the City of West Miami, may apply to the Office of Tourism,
197Trade, and Economic Development for designation of one
198enterprise zone within the City of West Miami. The application
199must be submitted by December 31, 2004, and must comply with the
200requirements of section 290.0055, Florida Statutes.
201Notwithstanding the provisions of section 290.0065, Florida
202Statutes, limiting the total number of enterprise zones
203designated and the number of enterprise zones within a
204population category, the Office of Tourism, Trade, and Economic
205Development may designate one enterprise zone under this
206section. The Office of Tourism, Trade, and Economic Development
207shall establish the initial effective date of the enterprise
208zone designated under this section.
209     Section 10.  (1)  Notwithstanding the limitation in section
210290.0065, Florida Statutes, on the number of enterprise zones
211within a population category, the Office of Tourism, Trade, and
212Economic Development shall designate, upon joint application by
213Miami-Dade County and the City of Hialeah, an area within the
214municipality of the City of Hialeah in an area bounded by 32nd
215Street, 21st Street, Palm Avenue, and East 4th Avenue as an
216enterprise zone. The application must be submitted by June 1,
2172004, and must comply with the requirements of section 290.0055,
218Florida Statutes, except for paragraph (4)(d). The effective
219date of the enterprise zone is July 1, 2004.
220     (2)  This section shall take effect upon becoming a law.
221     Section 11.  Notwithstanding any other provision of law, a
222governing body located wholly within the boundaries of a
223consolidated government may apply to the Office of Tourism,
224Trade, and Economic Development to amend the boundary of its
225existing enterprise zone. The area proposed for addition to the
226enterprise zone must include the three noncontiguous areas
227designated as a federal empowerment zone under the 2000
228Community Renewal Tax Relief Act without any limitations as to
229size. The Office of Tourism, Trade, and Economic Development may
230approve an amendment to the enterprise zone boundary lines if
231the application is submitted before December 31, 2004, and meets
232the requirements of this section.
233     Section 12.  If any provision of this act or its
234application to any person or circumstance is held invalid, the
235invalidity does not affect other provisions or applications of
236the act which can be given effect without the invalid provision
237or application, and to this end the provisions of this act are
238severable.
239     Section 13.  Except as otherwise expressly provided in this
240act, this act shall take effect July 1, 2004.
