11Development to designate an enterprise zone within an area
12of Osceola County or of Osceola County and the City of
13Kissimmee jointly; providing requirements with respect
14thereto; authorizing the governing body of certain
15counties to apply to the Office of Tourism, Trade, and
16Economic Development to amend the boundaries of a certain
17area within a certain enterprise zone; requiring the
18office to approve the application under certain
19circumstances; providing requirements; amending s.
20290.0065, F.S.; authorizing certain counties to apply to
21the Office of Tourism, Trade, and Economic Development to
22amend existing enterprise zone boundaries under specified
23conditions and in accordance with certain criteria;
24providing an effective date.

26Be It Enacted by the Legislature of the State of Florida:
27
28     Section 1.  Section 290.00702, Florida Statutes, is created
29to read:
30     290.00702  Enterprise zone designation for Osceola County
31or Osceola County and Kissimmee.--Osceola County, or Osceola
32County and the City of Kissimmee jointly, may apply to the
33Office of Tourism, Trade, and Economic Development for
34designation of one enterprise zone within the county or within
35both the county and the city. The application must be submitted
36by December 31, 2004, and must comply with the requirements of
37s. 290.0055. Notwithstanding the provisions of s. 290.0065
38limiting the total number of enterprise zones designated and the
39number of enterprise zones within a population category, the
40Office of Tourism, Trade, and Economic Development may designate
41one enterprise zone under this section. The Office of Tourism,
42Trade, and Economic Development shall establish the initial
43effective date of the enterprise zone designated under this
44section.
45     Section 2.  Notwithstanding any other provision of chapter
46290, Florida Statutes, the governing body of any inland county
47with a state-designated enterprise zone and a population greater
48than 500,000 may apply to the Office of Tourism, Trade, and
49Economic Development to amend the boundaries of such an
50enterprise zone. The increased areas shall be contiguous to the
51existing enterprise zone. The office shall approve the
52application as long as the amended area does not exceed 5 square
53miles and is consistent with the categories, criteria, and
54limitations imposed by s. 290.0055, Florida Statutes, upon the
55establishment of such enterprise zone. The enterprise zone
56boundary amendment application must be received before December
5731, 2004.
58     Section 3.  Subsection (12) is added to section 290.0065,
59Florida Statutes, to read:
60     290.0065  State designation of enterprise zones.--
61     (12)  Before November 30, 2004, any county as defined in s.
62125.011 may apply to the Office of Tourism, Trade, and Economic
63Development to change the boundaries of an existing enterprise
64zone for the purpose of replacing an area of not more than 75
65acres within the enterprise zone as of January 1, 2004, with an
66area of the same number of acres outside the enterprise zone as
67of January 1, 2004. The replacement area must be contiguous to
68the existing enterprise zone and must be a part of a
69revitalization area that has been targeted for assistance by the
70county. The replacement area also must be contiguous to a zoo
71and the county must have previously completed a master plan for
72development of the area. The Office of Tourism, Trade, and
73Economic Development shall approve the amendment effective
74January 1, 2005, if the enterprise zone remains consistent with
75the criteria and conditions imposed by s. 290.0055 upon the
76establishment of enterprise zones, including the requirement
77that the area suffer from pervasive poverty, unemployment, and
78general distress.
79     Section 4.  This act shall take effect July 1, 2004.
