5 | Section 10. Section 430.701, Florida Statutes, is amended |
6 | to read: |
7 | 430.701 Legislative findings and intent.-- |
8 | (1) The Legislature finds that state expenditures for |
9 | long-term care services continue to increase at a rapid rate and |
10 | that Florida faces increasing pressure in its efforts to meet |
11 | the long-term care needs of the public. It is the intent of the |
12 | Legislature that the Department of Elderly Affairs, in |
13 | consultation with the Agency for Health Care Administration, |
14 | implement long-term care community diversion pilot projects to |
15 | test the effectiveness of managed care and outcome-based |
16 | reimbursement principles when applied to long-term care. |
17 | (2) The agency may seek federal approval in advance of its |
18 | formal waiver application to limit the diversion provider |
19 | network by freezing enrollment of providers at current levels |
20 | when an area already has three or more providers or, in an |
21 | expansion area, when enrollment reaches a level of three |
22 | providers. This subsection does not prevent the department from |
23 | approving a provider to expand service to additional counties |
24 | within a planning and service area for which the provider is |
25 | already approved to serve. |
