17 and insert:
18 (45) Subject to the availability of funds, the agency
19 shall mandate a recipient's participation in a provider
20 lock-in program, when appropriate, if a recipient is found by
21 the agency to have used Medicaid goods or services at a
22 frequency or amount not medically necessary, limiting the
23 receipt of goods or services to medically necessary providers
24 after the 21-day appeal process has ended, for a period of
25 time that is reasonable and necessary to ensure that services
26 are appropriately used. The lock-in programs shall include,
27 but are not limited to, pharmacies, medical doctors, and
28 infusion clinics. The limitation does not apply to emergency
29 services and care provided to the recipient in a hospital
30 emergency department. The agency shall seek any federal
31 waivers necessary to implement this subsection. The agency
