6 Program by independent nonprofit colleges and
7 universities; amending s. 1009.891, F.S.;
8 revising eligibility requirements for
9 participation in the Access to Better Learning
10 and Education Grant Program by for-profit and
11 nonprofit colleges and universities; reenacting
12 ss. 282.105(4), 1009.57(2)(a), and 1009.765,
13 F.S., to incorporate the amendment to s.
14 1009.89, F.S., in references; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Subsection (3) of section 1009.89, Florida
20 Statutes, is amended to read:
21 1009.89 The William L. Boyd, IV, Florida resident
22 access grants.--
23 (3) The department shall issue through the program a
24 William L. Boyd, IV, Florida resident access grant to any
25 full-time degree-seeking undergraduate student registered at
26 an independent nonprofit college or university which is
27 located in and chartered by the state; which is accredited by
28 the Commission on Colleges of the Southern Association of
29 Colleges and Schools; which grants baccalaureate degrees; and
30 which is not a state university or state community college;
31 and which has a secular purpose, so long as the receipt of

1 state aid by students at the institution would not have the
2 primary effect of advancing or impeding religion or result in
3 an excessive entanglement between the state and any religious
4 sect. Any independent college or university that was eligible
5 to receive tuition vouchers on January 1, 1989, and which
6 continues to meet the criteria under which its eligibility was
7 established, shall remain eligible to receive William L. Boyd,
8 IV, Florida resident access grant payments.
9 Section 2. Subsection (3) of section 1009.891, Florida
10 Statutes, is amended to read:
11 1009.891 The Access to Better Learning and Education
12 Grant Program.--
13 (3) The department shall issue an access grant to any
14 full-time student seeking a baccalaureate degree who is
15 registered at a for-profit college or university that is
16 located in and chartered by the state and that is accredited
17 by the Commission on Colleges of the Southern Association of
18 Colleges and Schools or who is registered at a nonprofit
19 college or university that is chartered out of the state, that
20 has been located in the state for 10 years or more, and that
21 is accredited by the Commission on Colleges of the Southern
22 Association of Colleges and Schools, the Middle States
23 Association of Colleges and Schools, the North Central
24 Association of Colleges and Schools, or the New England
25 Association of Colleges and Schools; that grants baccalaureate
26 degrees; and that is not a state university or state community
27 college; and that has a secular purpose, if the receipt of
28 state aid by students at the institution would not have the
29 primary effect of advancing or impeding religion or result in
30 an excessive entanglement between the state and any religious
31 sect. Institutions eligible for the Access to Better Learning

1 and Education Grant Program in the initial year of funding
2 shall include only those for-profit colleges or universities
3 identified in this subsection. Nonprofit colleges or
4 universities identified in this subsection shall be eligible
5 for financial support in the second year of funding.
6 Section 3. For the purpose of incorporating the
7 amendment made by this act to section 1009.89, Florida
8 Statutes, in a reference thereto, subsection (4) of section
9 282.105, Florida Statutes, is reenacted to read:
10 282.105 Use of state SUNCOM Network by nonprofit
11 corporations.--
12 (4) Institutions qualified to participate in the
13 William L. Boyd, IV, Florida Resident Access Grant Program
14 pursuant to s. 1009.89 shall be eligible to use the state
15 SUNCOM Network, subject to the terms and conditions of the
16 office. Such entities shall not be required to satisfy the
17 other criteria of this section.
18 Section 4. For the purpose of incorporating the
19 amendment made by this act to section 1009.89, Florida
20 Statutes, in a reference thereto, paragraph (a) of subsection
21 (2) of section 1009.57, Florida Statutes, is reenacted to
22 read:
23 1009.57 Florida Teacher Scholarship and Forgivable
24 Loan Program.--
25 (2) Within the Florida Teacher Scholarship and
26 Forgivable Loan Program shall be established the "Chappie"
27 James Most Promising Teacher Scholarship which shall be
28 offered to a top graduating senior from each public secondary
29 school in the state. An additional number of "Chappie" James
30 Most Promising Teacher Scholarship awards shall be offered
31 annually to graduating seniors from private secondary schools

1 in the state which are listed with the Department of Education
2 and accredited by the Southern Association of Colleges and
3 Schools or any other private statewide accrediting agency
4 which makes public its standards, procedures, and member
5 schools. The private secondary schools shall be in compliance
6 with regulations of the Office for Civil Rights. The number of
7 awards to private secondary school students shall be
8 proportional to the number of awards available to public
9 secondary school students and shall be calculated as the ratio
10 of the number of private to public secondary school seniors in
11 the state multiplied by the number of public secondary schools
12 in the state.
13 (a) The scholarship may be used for attendance at a
14 state university, a community college, or an independent
15 institution as defined in s. 1009.89.
16 Section 5. For the purpose of incorporating the
17 amendment made by this act to section 1009.89, Florida
18 Statutes, in a reference thereto, section 1009.765, Florida
19 Statutes, is reenacted to read:
20 1009.765 Ethics in Business scholarships for community
21 colleges and independent postsecondary educational
22 institutions.--When the Department of Insurance or the Office
23 of Insurance Regulation of the Financial Services Commission
24 receives a $6 million settlement as specified in the Consent
25 Order of the Treasurer and Insurance Commissioner, case number
26 18900-96-c, that portion of the $6 million not used to satisfy
27 the requirements of section 18 of the Consent Order must be
28 transferred from the Insurance Regulatory Trust Fund to the
29 State Student Financial Assistance Trust Fund is appropriated
30 from the State Student Financial Assistance Trust Fund to
31 provide Ethics in Business scholarships to students enrolled

1 in public community colleges and independent postsecondary
2 educational institutions eligible to participate in the
3 William L. Boyd, IV, Florida Resident Access Grant Program
4 under s. 1009.89. The funds shall be allocated to institutions
5 for scholarships in the following ratio: Two-thirds for
6 community colleges and one-third for eligible independent
7 institutions. The Department of Education shall administer the
8 scholarship program for students attending community colleges
9 and independent institutions. These funds must be allocated to
10 institutions that provide an equal amount of matching funds
11 generated by private donors for the purpose of providing
12 Ethics in Business scholarships. Public funds may not be used
13 to provide the match, nor may funds collected for other
14 purposes. Notwithstanding any other provision of law, the
15 State Board of Administration shall have the authority to
16 invest the funds appropriated under this section. The
17 Department of Education may adopt rules for administration of
18 the program.
19 Section 6. This act shall take effect upon becoming a
20 law.
