2 An act relating to golf carts; amending s.
3 316.212, F.S.; permitting the operation of golf
4 carts on county roads or municipal streets in
5 25-miles-per-hour, or less, speed zones;
6 providing an effective date;

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 316.212, Florida
11 Statutes, is amended to read:
12 316.212 Operation of golf carts on certain
13 roadways.--The operation of a golf cart upon the public roads
14 or streets of this state is prohibited except as provided
15 herein:
16 (1)(a) A golf cart may be operated only upon a county
17 road that has been designated by a county, or a municipal city
18 street that has been designated by a municipality city, for
19 use by golf carts. Prior to making such a designation, the
20 responsible local governmental entity must first determine
21 that golf carts may safely travel on or cross the public road
22 or street, considering factors including the speed, volume,
23 and character of motor vehicle traffic using the road or
24 street. Upon a determination that golf carts may be safely
25 operated on a designated road or street, the responsible
26 governmental entity shall post appropriate signs to indicate
27 that such operation is allowed.
28 (b) A golf cart may also be operated upon a county
29 road or municipal street in an area where the speed limit is
30 25 miles per hour or less.
31 Section 2. This act shall take effect July 1, 2004.
