3     Amendment (with title amendment)
4     Remove everything after the enacting clause and insert:
5     Section 1.  The Legislature finds that it is of the utmost
6public importance that quality mammography services and other
7diagnostic tools remain available to detect and treat breast
8cancer. The Office of Program Policy Analysis and Government
9Accountability and the Department of Health shall study issues
10relating to the availability utilization, quality, and cost of
11mammography services in all facilities performing mammography.
12The study shall include, but need not be limited to, examining
13the following factors that impact availability utilization,
14quality, and cost: reimbursement fees, copayment fees paid by
15patients, incidence of lawsuits filed, equipment and liability
16insurance costs and insurance availability, equipment
17maintenance and calibration, staffing requirements and training,
18type and number of facilities performing mammography, facilities
19surveyed by the Bureau of Radiation Control of the Department of
20Health, population density of females aged 40 and older in each
21county, and other factors that relate to the demand and
22availability of mammography service. The Office of Program
23Policy Analysis and Government Accountability shall complete its
24study and submit its report to the Legislature by December 15,
252004.
26     (1)  There is also created the Workgroup on Mammography
27Accessibility within the Department of Health. The workgroup
28shall study:
29     (a)  The availability, quality of care, and accessibility
30of mammography in this state.
31     (b)  The need for research and educational facilities,
32including facilities with institutional training programs and
33community training programs for doctors of radiological medicine
34at the student, internship, and residency levels.
35     (c)  The availability of resources, including health
36personnel and management personnel for mammography programs.
37     (d)  The patient wait times for screening and diagnostic
38mammography.
39     (2)  The workgroup shall consist of 13 members and be
40staffed by the Department of Health. It shall be chaired by the
41Secretary of Health or his or her designee. The remaining 12
42members shall be appointed as follows: the Governor shall
43appoint four members, the President of the Senate shall appoint
44four members, one of whom shall be a member of the Senate, and
45the Speaker of the House of Representatives shall appoint four
46members, one of whom shall be a member of the House of
47Representatives. The Governor's appointees and the Legislature's
48appointees who are not members of the Legislature must have a
49background in mammography by either practicing or teaching or
50both as a physician in the field of mammography, insuring
51mammography health care providers, or trying or defending
52medical malpractice cases as an attorney.
53     (3)  By December 15, 2004, the department shall submit a
54report to the Governor, the President of the Senate, the Speaker
55of the House of Representatives, and the substantive legislative
56committees which provides the findings of the workgroup and
57recommendations for legislative action.
58     Section 2.  This act shall take effect upon becoming a law.

68     WHEREAS, breast cancer is the second leading cause of
69cancer deaths in women, and
70     WHEREAS, mammography is an imperfect screening test but the
71best tool available to detect breast cancer, and
72     WHEREAS, early detection of breast cancer decreases
73mortality by 30 percent, and
74     WHEREAS, the population of women who will need screening is
75increasing, NOW, THEREFORE,
