1 A bill to be entitled
2 An act relating to the State Apprenticeship
3 Advisory Council within the Division of
4 Workforce Development of the Department of
5 Education; amending s. 446.045, F.S.; deleting
6 a requirement that the Governor appoint two
7 nominating committees for the purpose of
8 filling vacancies on the council; requiring the
9 Governor to appoint certain members to the
10 council representing sponsors of joint employee
11 organizations and nonjoint employer
12 organizations; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Section 446.045, Florida Statutes, is
17 amended to read:
18 446.045 State Apprenticeship Advisory Council.--
19 (1) For the purposes of this section, the term:
20 (a) "Joint employee organization" means an
21 apprenticeship sponsor who participates in a collective
22 bargaining agreement and represents employees.
23 (b) "Nonjoint employer organization" means an
24 apprenticeship sponsor who does not participate in a
25 collective bargaining agreement and who represents management.
26 (2)(a) There is created a State Apprenticeship
27 Advisory Council to be composed of 13 members appointed by the
28 Governor, which shall be advisory to the Division of Workforce
29 Development. The purpose of the advisory council is to advise
30 the division and the council on matters relating to
31 apprenticeship. The advisory council may not establish

1 policy, adopt rules, or consider whether particular
2 apprenticeship programs should be approved by the division.
3 (b) The division director or the division director's
4 designee shall be ex officio chair of the State Apprenticeship
5 Advisory Council, but may not vote. The state director of the
6 Bureau of Apprenticeship and Training of the United States
7 Department of Labor shall be appointed a nonvoting member of
8 the council. The Governor shall appoint two three-member
9 committees for the purpose of nominating candidates for
10 appointment to the council. One nominating committee shall be
11 composed of joint employee organization representatives, and
12 the other nominating committee shall be composed of nonjoint
13 employer organization representatives. The joint employee
14 organization nominating committee shall submit to the Governor
15 the names of three persons for each vacancy occurring among
16 the joint employee organization members on the council, and
17 the nonjoint employer organization nominating committee
18 likewise shall submit to the Governor the names of three
19 persons for each vacancy occurring among the nonjoint employer
20 organization members on the council. The Governor shall
21 appoint to the council five members representing sponsors of
22 joint employee organizations and five members representing
23 sponsors of nonjoint employer organizations from the
24 candidates nominated for each position by the respective
25 nominating committees. Each member shall represent industries
26 that which have registered apprenticeship programs or in which
27 a need for apprenticeship programs has been demonstrated.
28 Initially, the Governor shall appoint four members for terms
29 of 4 years, two members for terms of 3 years, two members for
30 terms of 2 years, and two members for terms of 1 year.
31 Thereafter, Members shall be appointed for 4-year terms. A

1 vacancy shall be filled for the remainder of the unexpired
2 term.
3 (c) The council shall meet at the call of the chair or
4 at the request of a majority of its membership, but at least
5 twice a year. A majority of the voting members shall
6 constitute a quorum, and the affirmative vote of a majority of
7 a quorum is necessary to take action.
8 (d) The Governor may remove any member for cause.
9 (e) The council shall maintain minutes of each
10 meeting. The division shall keep on file the minutes of each
11 meeting and shall make such minutes available to any
12 interested person.
13 (f) Members of the council shall serve without
14 compensation, but shall be entitled to receive reimbursement
15 for per diem and travel expenses as provided in s. 112.061.
16 Section 2. This act shall take effect upon becoming a
17 law.

20 SENATE SUMMARY
21 Deletes provisions requiring the Governor to appoint two
committees for nominating candidates to vacancies on the
22 State Apprenticeship Advisory Council. Requires that the
Governor appoint members to the council who represent
23 sponsors of joint employee organizations and nonjoint
employer organization.
