1 A bill to be entitled
2 An act relating to health care practice
3 parameters; amending ss. 627.6418 and 627.6613,
4 F.S., relating to health insurance policy
5 coverage for mammograms; expressing legislative
6 intent that requirements for such coverage
7 conform to specified practice parameters;
8 repealing s. 408.02, F.S., which requires that
9 the Agency for Health Care Administration
10 develop, endorse, and implement such
11 parameters; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (1) of section 627.6418, Florida
16 Statutes, is amended to read:
17 627.6418 Coverage for mammograms.--
18 (1) An accident or health insurance policy issued,
19 amended, delivered, or renewed in this state must provide
20 coverage for at least the following:
21 (a) A baseline mammogram for any woman who is 35 years
22 of age or older, but younger than 40 years of age.
23 (b) A mammogram every 2 years for any woman who is 40
24 years of age or older, but younger than 50 years of age, or
25 more frequently based on the patient's physician's
26 recommendation.
27 (c) A mammogram every year for any woman who is 50
28 years of age or older.
29 (d) One or more mammograms a year, based upon a
30 physician's recommendation, for any woman who is at risk for
31 breast cancer because of a personal or family history of

1 breast cancer, because of having a history of biopsy-proven
2 benign breast disease, because of having a mother, sister, or
3 daughter who has or has had breast cancer, or because a woman
4 has not given birth before the age of 30.

6 It is the intent of the Legislature that the requirements of
7 this section conform to the practice parameters relating to
8 mammograms as recognized by the United States Agency for
9 Healthcare Research and Quality , when practice parameters for
10 the delivery of mammography services are developed pursuant to
11 s. 408.02(7), the Legislature review the requirements of this
12 section and conform to the practice parameters.
13 Section 2. Subsection (1) of section 627.6613, Florida
14 Statutes, is amended to read:
15 627.6613 Coverage for mammograms.--
16 (1) A group, blanket, or franchise accident or health
17 insurance policy issued, amended, delivered, or renewed in
18 this state must provide coverage for at least the following:
19 (a) A baseline mammogram for any woman who is 35 years
20 of age or older, but younger than 40 years of age.
21 (b) A mammogram every 2 years for any woman who is 40
22 years of age or older, but younger than 50 years of age, or
23 more frequently based on the patient's physician's
24 recommendation.
25 (c) A mammogram every year for any woman who is 50
26 years of age or older.
27 (d) One or more mammograms a year, based upon a

17 SENATE SUMMARY
18 Repeals the requirement that the Agency for Health Care
Administration develop, endorse, and implement health
19 care practice parameters. Revises requirements relating
to health insurance policy coverage for mammograms by
20 expressing legislative intent that those requirements
conform to practice parameters recognized by the United
21 States Agency for Healthcare Research and Quality.
