  1                      A bill to be entitled

  2         An act relating to health care practice

  3         parameters; amending ss. 627.6418 and 627.6613,

  4         F.S., relating to health insurance policy

  5         coverage for mammograms; deleting provisions

  6         expressing the legislative intent that

  7         requirements for such coverage conform to

  8         specified practice parameters; repealing s.

  9         408.02, F.S., which requires that the Agency

10         for Health Care Administration develop,

11         endorse, and implement such parameters;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Subsection (1) of section 627.6418, Florida

17  Statutes, is amended to read:

18         627.6418  Coverage for mammograms.--

19         (1)  An accident or health insurance policy issued,

20  amended, delivered, or renewed in this state must provide

21  coverage for at least the following:

22         (a)  A baseline mammogram for any woman who is 35 years

23  of age or older, but younger than 40 years of age.

24         (b)  A mammogram every 2 years for any woman who is 40

25  years of age or older, but younger than 50 years of age, or

26  more frequently based on the patient's physician's

27  recommendation.

28         (c)  A mammogram every year for any woman who is 50

29  years of age or older.

30         (d)  One or more mammograms a year, based upon a

31  physician's recommendation, for any woman who is at risk for

 1  breast cancer because of a personal or family history of

 2  breast cancer, because of having a history of biopsy-proven

 3  benign breast disease, because of having a mother, sister, or

 4  daughter who has or has had breast cancer, or because a woman

 5  has not given birth before the age of 30.

 7  It is the intent of the Legislature that, when practice

 8  parameters for the delivery of mammography services are

 9  developed pursuant to s. 408.02(7), the Legislature review the

10  requirements of this section and conform to the practice

11  parameters.

12         Section 2.  Subsection (1) of section 627.6613, Florida

13  Statutes, is amended to read:

14         627.6613  Coverage for mammograms.--

15         (1)  A group, blanket, or franchise accident or health

16  insurance policy issued, amended, delivered, or renewed in

17  this state must provide coverage for at least the following:

18         (a)  A baseline mammogram for any woman who is 35 years

19  of age or older, but younger than 40 years of age.

20         (b)  A mammogram every 2 years for any woman who is 40

21  years of age or older, but younger than 50 years of age, or

22  more frequently based on the patient's physician's

23  recommendation.

24         (c)  A mammogram every year for any woman who is 50

25  years of age or older.

26         (d)  One or more mammograms a year, based upon a

27  physician's recommendation, for any woman who is at risk for

28  breast cancer because of a personal or family history of

 4  It is the intent of the Legislature that, when practice

 5  parameters for the delivery of mammography services are

 6  developed pursuant to s. 408.02(7), the Legislature review the

 9         Section 3.  Section 408.02, Florida Statutes, is

10  repealed.

11         Section 4.  This act shall take effect upon becoming a

12  law.

14          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
15                         Senate Bill 1092

16                                 

17  The Committee Substitute removes an unclear reference to
    practice parameters adopted by the U.S. Agency for Healthcare
18  Research and Quality, and deletes the requirement that
    insurance coverage for mammography be in accordance with
19  practice parameters developed by the Agency for Healthcare
    Administration.
