  1                      A bill to be entitled

  2         An act relating to victim assistance; amending

  3         s. 960.03, F.S., relating to the Florida Crimes

  4         Compensation Act; redefining the term "crime"

  5         to eliminate the offense of intentional

  6         vehicular homicide as a crime that is

  7         compensable under the act; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraph (b) of subsection (3) of section

13  960.03, Florida Statutes, is amended to read:

14         960.03  Definitions; ss. 960.01-960.28.--As used in ss.

15  960.01-960.28, unless the context otherwise requires, the

16  term:

17         (3)  "Crime" means:

18         (b)  A violation of s. 316.193, s. 316.027(1), s.

19  327.35(1), s. 782.071(1) (b), or s. 860.13(1)(a) which results

20  in physical injury or death; however, no other act involving

21  the operation of a motor vehicle, boat, or aircraft which

22  results in injury or death shall constitute a crime for the

23  purpose of this chapter unless the injury or death was

24  intentionally inflicted through the use of such vehicle, boat,

25  or aircraft or unless such vehicle, boat, or aircraft is an

26  implement of a crime to which this act applies.

27         Section 2.  This act shall take effect July 1, 2004.

 3    Revises the definition of the term "crime" under the
      Florida Crimes Compensation Act to provide that
 4    intentional vehicular homicide is no longer a crime for
      which compensation is paid pursuant to the act.
