A bill to be entitled
2An act relating to recreational activities at facilities
3for elderly or disabled adults; authorizing bingo games
4for residents or clients of certain facilities for the
5elderly or disabled and for their guests; providing
6conditions; providing for use of proceeds; providing
7exemption from local regulation and fees; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Notwithstanding section 849.0931, Florida
13Statutes, bingo games for residents or clients of facilities
14licensed or authorized under part II, part III, or part V of
15chapter 400, Florida Statutes, chapter 651, Florida Statutes, or
16section 430.206, Florida Statutes, and for their guests, or for
17residents of government-financed, government-insured, or
18government-subsidized housing for the elderly and their guests,
19may be conducted if such games are held in the facility, played
20exclusively by residents or clients and their guests, and
21conducted by residents, staff, or volunteers of the facility,
22and if neither the facility nor any third party derives
23financial benefit from such games. Games conducted in a facility
24licensed under part II, part III, or part V of chapter 400,
25Florida Statutes, for residents or clients with a diagnosis of
26Alzheimer's disease or a related dementia may not be played with
27the personal funds of residents or clients and must be
28supervised by paid or volunteer staff. Prizes may be claimed
29only by residents or clients of these facilities or by guests
30who are residents or clients of other similarly licensed or
31authorized facilities. Net proceeds must be returned to players
32in the form of prizes after expenses for refreshments and bingo
33supplies are deducted. Any county or municipality that regulates
34the playing of bingo shall exempt bingo games conducted pursuant
35to this section from regulation and fees.
36     Section 2.  This act shall take effect July 1, 2004.
