| 3 | amending s. 319.23, F.S.; requiring the Department of |
| 4 | Highway Safety and Motor Vehicles to maintain certain |
| 5 | records for 10 years; providing an effective date. |

| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |
|
| 9 | Section 1. Subsection (5) of section 319.23, Florida |
| 10 | Statutes, is amended, and subsection (11) is added to that |
| 11 | section, to read: |
| 12 | 319.23 Application for, and issuance of, certificate of |
| 13 | title.-- |
| 14 | (5) The certificate of title issued by the department for |
| 15 | a motor vehicle or mobile home previously registered outside |
| 16 | this state shall give the name of the state or country in which |
| 17 | the vehicle was last registered outside this state. The |
| 18 | department shall retain the evidence of title presented by the |
| 19 | applicant upon which the certificate of title is issued. The |
| 20 | department shall use reasonable diligence in ascertaining |
| 21 | whether or not the facts in the application are true; and, if |
| 22 | satisfied that the applicant is the owner of the motor vehicle |
| 23 | or mobile home and that the application is in the proper form, |
| 24 | it shall issue a certificate of title. |
| 25 | (11) All titles, manufacturers' statements of origin, |
| 26 | applications, and supporting documents submitted with the |
| 27 | application, including, but not limited to, odometer statements, |
| 28 | vehicle identification number verifications, bills of sale, |
| 29 | indicias of ownership, dealer reassignments, photographs, and |
| 30 | any personal identification, affidavits, or documents required |
| 31 | by or submitted to the department, shall be retained by the |
| 32 | department for not less than 10 years. |
| 33 | Section 2. This act shall take effect July 1, 2004. |
