1 A bill to be entitled
2 An act relating to automated external
3 defibrillators; amending s. 401.2915, F.S.;
4 revising legislative intent with respect to the
5 use of an automated external defibrillator;
6 classifying an automated external defibrillator
7 as a lifesaving device; defining a related
8 term; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 401.2915, Florida Statutes, is
13 amended to read:
14 401.2915 Automated external defibrillators.--It is the
15 intent of the Legislature that an automated external
16 defibrillator may be used by any person for the purpose of
17 saving the life of another person in cardiac arrest. In order
18 to achieve that goal, the Legislature intends to encourage
19 training in lifesaving first aid, set standards for the use of
20 automated external defibrillators, and encourage their use.
21 (1) As used in this section, the term:
22 (a) "Automated external defibrillator" means a
23 lifesaving defibrillation device that:
24 1. Is commercially distributed as a defibrillation
25 device in accordance with the Federal Food, Drug, and Cosmetic
26 Act;
27 2. Is capable of recognizing the presence or absence
28 of ventricular fibrillation and is capable of determining,
29 without intervention by the user of the device, if
30 defibrillation should be performed; and

1 3. Is capable of delivering an electrical shock to an
2 individual, upon determining that defibrillation should be
3 performed.
4 (b) "Defibrillation" means the administration of a
5 controlled electrical charge to the heart to restore a viable
6 cardiac rhythm.
7 (2) In order to ensure public health and safety:
8 (a)(1) All persons who use an automated external
9 defibrillator must obtain appropriate training, to include
10 completion of a course in cardiopulmonary resuscitation or
11 successful completion of a basic first aid course that
12 includes cardiopulmonary resuscitation training, and
13 demonstrated proficiency in the use of an automated external
14 defibrillator;
15 (b)(2) Any person or entity in possession of an
16 automated external defibrillator is encouraged to register
17 with the local emergency medical services medical director the
18 existence and location of the automated external
19 defibrillator; and
20 (c)(3) Any person who uses an automated external
21 defibrillator shall is required to activate the emergency
22 medical services system as soon as possible upon use of the
23 automated external defibrillator.
24 Section 2. This act shall take effect upon becoming a
25 law.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 Senate Bill 1100

4 The committee substitute provides a new definition of
"automated external defibrillator," removing a specific
5 reference to the United States Code, and requiring, instead,
that the device be commercially distributed as a
6 defibrillation device in accordance with the Federal Food,
Drug and Cosmetic Act.
