7320.08056 and 320.08058, F.S.; creating the Parents Make A
8Difference license plate and the Florida National Guard
9license plate; providing for annual use fees; providing
10for the distribution of such fees received from the sale
11of the plates; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Paragraphs (ss) and (tt) are added to
16subsection (4) of section 320.08056, Florida Statutes, to read:
17     320.08056  Specialty license plates.--
18     (4)  The following license plate annual use fees shall be
19collected for the appropriate specialty license plates:
20     (ss)  Parents Make A Difference license plate, $25.
21     (tt)  Florida National Guard license plate, $25.
22     Section 2.  Subsections (45) and (46) are added to section
23320.08058, Florida Statutes, to read:
24     320.08058  Specialty license plates.--
25     (45)  PARENTS MAKE A DIFFERENCE LICENSE PLATES.--
26     (a)  The department shall develop a Parents Make A
27Difference license plate as provided in this section. The words
28"Parents Make A Difference" must appear at the top of the plate,
29and the word "Florida" must appear at the bottom of the plate.
30     (b)  The annual use fees shall be distributed to The
31Gathering/USA, Inc., to fund personal counseling for parents,
32marriage seminars, Dads and Moms That Make A Difference
33seminars, father-and-son retreats, mother-and-daughter retreats,
34and personal parenting behavioral assessments. The
35Gathering/USA, Inc., shall distribute the Parents Make A
36Difference license plate annual use fees in the following
37manner:
38     1.  The Gathering/USA, Inc., shall retain all revenues from
39the sale of such plates until all startup costs for developing
40and establishing the plate have been recovered.
41     2.  Up to 5 percent of the funds received by The
42Gathering/USA, Inc., shall be expended for administrative costs
43directly associated with the operations of The Gathering/USA,
44Inc., and up to 20 percent of the funds received shall be
45expended for promotion and marketing of the license plate.
46     3.  All remaining funds shall be expended by The
47Gathering/USA, Inc., for programs.
48     (46)  FLORIDA NATIONAL GUARD LICENSE PLATES.--
49     (a)  Notwithstanding the provisions of s. 320.08053, the
50department shall develop a Florida National Guard license plate
51as provided in this section. The word "Florida" must appear at
52the top of the plate, and the words "National Guard" must appear
53at the bottom of the plate. The Florida National Guard seal, two
54and three-quarters inches in diameter, must appear in the center
55of the plate in proper colors.
56     (b)  The department shall retain initial annual use fee
57proceeds sufficient to cover its costs related to the
58development and issuance of the Florida National Guard license
59plate, not to exceed $60,000. The For Giving Foundation, Inc.,
60may retain revenues from the sale of the license plate until its
61documented startup costs for developing and establishing the
62plate have been recovered. Thereafter, the proceeds of the
63annual use fees shall be distributed to the For Giving
64Foundation, Inc., to fund the Florida National Guard Foundation
65and Florida faith-based organizations that meet the
66qualifications of s. 501(c)(3) of the Internal Revenue Code. The
67For Giving Foundation, Inc., shall distribute the Florida
68National Guard license plate annual use fees in the following
69manner:
70     1.  Up to 5 percent of the funds received by the For Giving
71Foundation, Inc., shall be expended for administrative costs
72directly associated with the operations of the foundation. Up to
7320 percent of the funds received shall be expended for promotion
74and marketing of the license plate.
75     2.  Fifty percent of the funds received by the For Giving
76Foundation, Inc., shall be distributed to the Florida National
77Guard Foundation.
78     3.  Twenty-five percent of the funds received by the For
79Giving Foundation, Inc., shall be expended to Florida faith-
80based s. 501(c)(3) organizations.
81     Section 3.  This act shall take effect July 1, 2004.
