1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Florida Alternative Electric Energy Trust Fund;
4 providing for sources of funds and purposes;
5 requiring funds to remain in the trust fund at
6 the end of each fiscal year; providing for
7 future review and termination or re-creation of
8 the fund; providing a contingent effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) The Florida Alternative Electric
14 Energy Trust Fund is created within, and shall be administered
15 by, the Florida Public Service Commission. Moneys deposited
16 into the fund shall be those collected pursuant to the
17 Alternative Electric Energy Surcharge provided in section
18 366.95, Florida Statutes, or from other sources designated by
19 law, federal moneys made available for alternative energy
20 uses, donations, or moneys appropriated from the General
21 Revenue Fund. The purpose of the trust fund is to provide
22 funding for the Florida Alternative Energy Technology Center
23 in fulfilling its statutory duties.
24 (2) Notwithstanding section 216.301, Florida Statutes,
25 and under section 216.351, Florida Statutes, any balance in
26 the trust fund at the end of any fiscal year shall remain in
27 the trust fund at the end of the fiscal year and shall be
28 available for carrying out the purposes of the trust fund.
29 (3) In accordance with Section 19(f)(2), Article III
30 of the State Constitution, the trust fund must, unless
31 terminated sooner, be terminated on July 1, 2008. Before its

1 scheduled termination, the trust fund must be reviewed as
2 provided in section 215.3206(1) and (2), Florida Statutes.
3 Section 2. This act shall take effect July 1, 2004,
4 but it shall not take effect unless it is enacted by a
5 three-fifths vote of the membership of each house of the
6 Legislature.

11 The CS for SB 112 creates the Florida Alternative Electric
Energy Trust Fund within the Public Service Commission to
12 receive moneys collected pursuant to the Alternative Electric
Energy Surcharge and other funds and to be used to fund the
13 Florida Alternative Energy Technology Center. The fund may
carry over unspent balances. It will terminate July 1, 2008,
14 and is to be reviewed by the Legislature prior to that date.
