  1                      A bill to be entitled

  2         An act relating to dermatological services;

  3         creating s. 458.3245, F.S.; requiring a

  4         dermatologist to directly supervise a person

  5         who is not licensed to practice medicine while

  6         that person performs specified services;

  7         creating s. 459.0126, F.S.; requiring a

  8         dermatologist to directly supervise a person

  9         who is not licensed to practice osteopathic

10         medicine while that person performs specified

11         services; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 458.3245, Florida Statutes, is

16  created to read:

17         458.3245  Dermatological supervision requirements.--

18         (1)  A dermatologist must directly supervise a person

19  with whom the dermatologist has a supervisory relationship and

20  who is not licensed to practice medicine under this chapter in

21  this state when that person:

22         (a)  Evaluates a new, nonemergency patient; or

23         (b)  Encounters any new dermatological problems.

24         (2)  As used in this section, the term "directly

25  supervise" means the dermatologist is present in the same

26  office suite as the person being supervised.

27         Section 2.  Section 459.0126, Florida Statutes, is

28  created to read:

29         459.0126  Dermatological supervision requirements.--

30         (1)  A dermatologist must directly supervise a person

31  with whom the dermatologist has a supervisory relationship and

 1  who is not licensed to practice osteopathic medicine under

 2  this chapter in this state when that person:

 3         (a)  Evaluates a new, nonemergency patient; or

 4         (b)  Encounters any new dermatological problems.

 5         (2)  As used in this section, the term "directly

 6  supervise" means the dermatologist is present in the same

 7  office suite as the person being supervised.

 8         Section 3.  This act shall take effect upon becoming a

 9  law.
